I'mool AN ORDINANCE CREATING A NEW CHAPTER 759 OF THE BUSINESS REGULATION CODE OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED "SALE OF IRRADIATED FOODS", AND DECLARING AN EMERGENCY. WHEREAS, the Federal Drug Administration has permitted the radiation of food using radioactive sources including x-rays, electron beams and gamma rays, and WHEREAS, such treatment of food has not all together been demonstrated to be without harmful or hazardous effects upon human consumption, and WHEREAS, other states have undertaken legislation to prohibit the sale of irradiated foods within their borders, and WHEREAS, the pronounced primary purpose of such radiation treatment of foods is extension of shelf life without any apparent health benefit for consumers, and WHEREAS, significant studies exist that strongly indicate that irradiation of foods constitutes a danger to human health because of the creation of carcenogens and other factors, and WHEREAS, it is in the best interest of all citizens of the City of North Olmsted that use of radiation for treating foods should not be per- mitted until such time as there is clear and convincing evidence that there is no harmful effect upon the health of our citizens, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That there is hereby created a new Section 759 in the Business Regulation Code of the Codified Ordinances of the City of North Olmsted entitled "Sa1e of Irradiated Foods", which newly created Section shall read as follows: 759 SALE OF IRRADIATED FOODS.
