? <br />? <br />CITY OF NORTH OLMSTED <br />ORDINANCE Nd. 94-26 <br />BY: COUNCILWOMAN SARINGER <br />AN ORDINANCE AUTHQRIZING THE DIRECTOR OF PUBLIC SERVICE <br />TO MAICE EMERGENCY REPAIRS ON THE D4VER AND LEBERN LIFT <br />STATIONS WITH RESFECT TO THE VALVES WHICH ARE AN INTE- <br />GRAL PART OF THE PUMPING SYSTEM, WITHOUT FUBLIC BID- <br />DING, AND DECLARING IT AN EMERGENCY. <br />WHEREAS, recent inspection of the vaIve system at both the Dover and <br />Lebern Lift Stations by the consuIting firm of URS DaIton has indicated <br />that the vaIves are in immediate need of replacement; and <br />WHEREAS, the atoresaid problem has reached such a criticaI state that <br />public bidding and the time associated therewith woulQ be too time consum- <br />ing to meet the City's obIigation to protect the public heaIth, safety and <br />welfare; and <br />WHEREAS, upon the recomemendation of the consultinq engineer, this <br />Council deems it an emergency sufficient in magnatitude to toregoe public <br />bidding on said project in order to protect the public health, safety and <br />weIfare of the residents Iocated in the districts where said Lift Stations <br />are Iocated. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NdRTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of PubIic Service is hereby authorized <br />to soIicit estimates for the repair of the aforesaid Lift Stations and that <br />upon receiving satisfactory estimates from more than one contractor, said <br />estimates shalI be presented to the Board of Control, and, upon the approv- <br />aI of the Board ot ControI, the Mapor, be and he is hereby authorized to <br />enter into a contract for the repair of said Lift Stations. <br />SECTION 3: That this ordinance is hereby declared an emergency meas- <br />ure necessary for the preservation of the public heaIth, safety and weI- <br />tare, and for the further reason that it is immediateIy necessary to pro- <br />tect the residents Iocated within the area serviced by said Lift Stations <br />and turther provided it receives the atfirmative vote of two-thirds of aII <br />members elected to CounciI, it shalI go into immediate force and effect <br />upon its signing by the Mayor. <br />PASSED: 4 . /99G <br />ATTEST: <br />FLORENCE E.
