<br />? <br />CITY OF NORTH OLMSTED <br />ORDINANCE 90 - 8 <br />BY : &12 r <br />AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS PERSONAL PROPERTY <br />OWNED BY THE CITY OF NpRTH OLMSTED AND PREVTOUSLY USED BY THE <br />DEPARTMENT OF PUBLIC SERVTCE, AND DECLARING AN EMERGENCY, AS AP4ENDED. <br />WHEREAS, the Council and the Administration have determined that various <br />items of personal property owned by the City of North Olmsted and formerly used <br />by the Department of Public Service are no longer needed for municipal purposes, <br />and <br />WHEREAS, it is the desire of this Council to sell said personal property <br />in accordance with law. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the following personal property was formerly used by the <br />Department of Public Service and is no longer needed for municipal business, <br />to wit: <br />See attached Schedule "A" made a part hereof as though <br />fully rewritten herein. <br />SECTION 2: That the Mayor be and he is hereby authorized to sell said <br />personal property to the highest bidder according to law, provided however, that <br />the highest bid is approved by the Board of Control and further provided that the <br />highest bidder shall, upon acceptance of the bid, pay to the Director of Finance <br />of the City of North Olmsted, twenty-five percent (25%) of the bid price and that <br />within five (5) days thereafter, the entire bid price shall be paid and the <br />successful bidder shall accept and remove said property from the premises of the <br />City. The Mayor, having been advised upon receipt of the full bid price shall, <br />if necessary, execute any and all documents required 6y law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the Public Health, Safety and Welfare <br />and for the further reason that the sa1e of surplus equipment is necessary to <br />protect the value thereof for resale purposes. <br />PASSED: _2Iatic? /, /96 <br />ATTEST: <br />7161" <br />FLORENCE E.
