<br />CITY OF NORTH OLMSTID <br />ORDINANCE N0. 92 - 157 <br />BY: COUNCILMAN GEORGE NASFIAR <br />AN ORDINANCE ACCEPTING AN EASIIKIIQT FOR THE INSTALLATION AND <br />MAINTENANCE OF A WATIIZ LINE FOR THE PURPOSE OF SUPPLYING WATER SERVICE BY <br />'IIiE CITY OF CLEVELAND TO LAND OWNED BY NORTH OLMSTID GOLF COURSE, INC. <br />ANID SHORE WEST CONSTRUCTION COMPANY. <br />WHEREAS, North Olmsted Golf Couse, Inc and Shore West Construction Company <br />desires to extend a water main into their property for the View Point <br />Development, and <br />W.EIEREAS, the City of Cleveland requires that extension of water lines shall <br />only be approved if easements are granted to both the City of Cleveland and <br />the City of North Olmsted in order that water mains ma.y be constructed and <br />maintained therein, and <br />WHIItEAS, this Council deems it in the best interest of the City to accept <br />the water main easement described herein; attached Exhibit "D. <br />NOW, UHREFORE, BE IT ORDAINED BY 'IHE COUNCIL OF TfiE CITY OF NORTH <br />OLMSTID, COUNi'Y OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accepts an easement from North <br />Olmsted Golf Course, Inc. and Shore West Construction Company for the <br />installation and maintenance of a water ma.in for the purpose of supplying water <br />service by the City of Cleveland, to the property of North Olmsted Golf Course, <br />Inc. and Shore West Construction Company. <br />SECTION 2: That the Clerk of this Council is hereby authorized to forward <br />a certified copy of this Ordinance to the Director of Public Utilities of the <br />City of Cleveland. <br />SECTION 3: That it is found and determined that all formal actions of this <br />Council concerning and relating to the adoption of this Ordinance were adopted <br />in an open meeting of this Council, and that all deliberations of this Council, <br />and of its committees that resulted in such formal action, were in meetings open <br />to the public in compliance with all legal requirements, including Section <br />121.22 of the Ohio Revised Code. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency <br />measure irrrmediately necessary for the preservation of the public health, safety <br />and welfare, and further provide it receives the affirmative vote of two-thirds <br />of all members of Council, it sha.ll take effect and be in force imnediately upon <br />its passage and approval by the Mayor.
