Saringer <br />AN ORDINANCE ACCEPTING AN EASIIMENT FOR 'THE INSTALLATION <br />AND MAINTENANCE OF A WATER LINE FOR THEE PURPOSE OF <br />CIRCULATION OF WATII2 SERVICE BY 'IIiE CITY OF CLEVELAND TO <br />LAND OWNED BY THE SHORE WEST CONSTRUCTION COMPANY AND <br />DECLARING AN IlKERGENCY. <br />WHEREAS, Shore West Construction Company desires to extend a water <br />main into their property for the View Point Development, and <br />WHIItEAS, the City of Cleveland requires that extension of water <br />lines shall only be approved if easements are granted to both the City <br />of Cleveland and the City of North Olmsted in order that water mains may <br />be constructed and maintained therein, and <br />WHEREAS, this Council deems it in the best interest of the City to <br />accept the water main easement described herein; attached Exhibit "A". <br />NOW THEREFORE, BE IT ORDAINED BY gIEE COUNCIL OF THE CITY OF NORTH <br />OLMSTID, COLTNTY OF CLIYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept an easement from <br />Shore West Construction Company for the installation and maintenance of <br />a water main for the purpose of circulation of water service by the City <br />of Cleveland to the property of Shore West Construction Company. <br />SECTION 2: That the Clerk of this Council is hereby authorized to <br />forward a certified copy of this Ordinance to the Director of Public <br />Utilities of the City of Cleveland. <br />SECTION 3: That it is found and determined that all formal <br />actions of this Council concerning and relating to the adoption of this <br />Ordinance were adopted in an open meeting of this Council, and that all <br />deliberations of this Council and of any of its committees that resulted <br />in such formal action, were in meetings open to the public in compliance <br />with all legal requirements, including Section 121.22 of the Ohio <br />Revised Code.
