ORDINANCE NO. 96 - 23 <br />BY: Mayor Ed Boyle <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO AN AGREEMENT WITH WESTERN RESERVE <br />ENGINEERING & SURVEYING CO. TO PROVIDE ENGINEERING SERVICES FOR <br />THE INSPECTION AND EVALUATION OF SANITARY MANHOLES IN THE AREA <br />TRIBUTARY TO THE LEBERN LIFT STATION AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the sanitary manholes in the area tributary to the LeBern Lift Station are in <br />need of reinspection and evaluation in order to comply with the requirements of the Ohio <br />Environmental Protection Agency; and <br />WHEREAS, the Mayor has recommended that the services of the Western Reserve <br />Engineering & Surveying Co., be hired to accomplish the aforesaid services due to their expertise <br />in this field; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does hereby express <br />its desire to have the Mayor enter into a contract with said firm for and on behalf of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COZ.INTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an <br />Agreement with Western Reserve Engineering & Surveying Co., to provide the inspection and <br />evaluation of sanitary manholes in the area tributary to the LeBern Lift Station. A copy of said <br />Agreement is attached hereto and made a part hereof and marked Exiibit "A". <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to proceed with the engineering services for this <br />project to stay within the schedule required by the County of Cuyahoga Department of <br />Development and further provided it receives the affirmative vote of two-thirds of all members <br />of Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor.
