<br />c . <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96 - 178 <br />BY: Councilman McKav <br />AN ORDINANCE ACCEPTING A SANITARY SEWER EASEMENT LOCATED <br />ON PROPERTY OWNED BY SAMUEL J. AND JOAN C. CAPICCIONI <br />AND DESIGNAT'ED AS PERMANENT PARCEL NO. 231-18-11 CUYAHOGA <br />COUNT'Y MAPS AND RECORDS, SAID EASEMENT SHOWN ON EXIIIBIT "C" AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has agreed to pay all costs and expense for the <br />construction of the sanitary sewer improvement within the easement area as shown on the Exhibit <br />"A" and "B". <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. <br />SECTION 1: That the City hereby accepts an easement from Samuel J. and Joan Capiccioni <br />for a sanitary sewer improvement, as shown on Exhibit "A" and "B". <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said <br />easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby deternuned to be an emergency measure necessary <br />for the immediate preservaUon of the public peace, property, health and safety of the City, and further <br />provided it receives the affirmaUve vote of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />PASSE : ,/ 7 /'?l/z <br />ST: <br />_..?_Q.,,,,, IV a?-e <br />Barbara L.
