I .a+.r:. ...... .. .. .. . . . .... .. ... . . . . <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96-172 <br />BY: Mayor Ed Boyle and All of Council <br />AN ORDINANCE RESCINDING THE AGREEMENT FOR GRADING, DRAINING <br />AND PAVING IMPROVEMENTS OF CLAGUE ROAD BETWEEN MASTICK ROAD <br />AND LORAIN ROAD AS AUTHORIZED BY ORDINANCE NO. 85-43, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council has deternuned that it is not in the best intent of the City to <br />proceed with plans for a four lane roadway between Lorain Road and Mastick Road. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby rescinds the agreement for the grading, drainage and <br />paving improvements for a four-lane roadway between Lorain Road and Mastick Road as <br />authorized by Ordinance Number 85-43 and any prior or subsequent Ordinance. <br />SECTION 2: That the City agrees to pay to the County for the cost to date of the <br />preparation of plans and specifications for said improvements. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, property, health and safety of the <br />City, and further provided that it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor.
