City An emergency ordinance enacted by the ?e of___K4rS.h._0].Aatesi.------------------------ --------- Cuyabosa----------------- County, Ohio, in the matter of the hereinafter described improvement, under the supervision of the Director of Highways. WHEREAS, the Director of Highways is considering improving a portion of the public high- way which is described as #ollows: (Location and general nature of work) °. The improvement of S.R.CUY.252-(3.45), the Mallet Creek-Bay Village Road, ?s known locally as Coluvbd* Road, by removing a portiun of the existiag asphaltic concrete surface and resurfacing the euisting pavement with asphaltic coacrete on that part of the desigaated route which lies within the corpc>rate linits of the Citq of North Olmsted aad between the following described termini: Beginning fn the centerline of Columbia Road as nox established, at a pcrint on a southerly corporatiou liae of North Olmsted; thence from said place of begini?ing northerlq along said centerline to its point of intersection with the established center- line of S.R. 10 (Lorain Road) and there terminate, being in all a diataace oE abont 2.14 miles. No Right of Wap required. City NOW THEREFORE, Be it ordained by the Council of the 'Mkp of__Notth_S21mstesl_, Ohio: SECTION I (Consent) City That it is declared to be in the public interest that the consent of said Vidb@e be and st},ch con- sent is hereby given to the Director of Highways to construct the above described improvement, in accordance with plans, specifications and estimates as prepared by said Director. SECTION :II (Cooperation) City That said Ak*bMs, hereby proposes to cooperate with the State of Ohio, in the cost of the above described improvement, by assuming and contributing twenty percent (20S) of the cost of constrnctien, plus oae hnadred percent (100x) of the coat of all materials and labor neceseary to rearrange aud adgust to the nef+ grade, all pater msias, service lines, fire hydrants, vslve boses, sanitary sewers or other maicipally-owwd utilities aad/or appurtenancee thereto necessary to conform to said inproveaent. 4 inclusive of the cost of engineering, contingencies and other incidental expenses. SECTION III (Authority to Sign) That the__ _ _ Mayor ___________________of said City ?ge, is hereby authorized to enter into main- ------- tenance and parking agreements and special contractual obligations. SECTION IV (Maintenance) Cit That it is hercby agreed that said i will, after completion of the aforementioned project, maintain the improvement herein contemplated in accordance with the provisions of the statutes relating thereto and will make ample financial and other provisions for such maintenance, and maintain the right of way and keep it free of obstructions in a manner satisfactory to the State of Ohio.
