CITY OF NORTH OLMSTED <br />RESOLUTION N0. ~~P <br />By Mr. ~C /~~~/ <br />~, RESOLUTION DIRECTING SOLICITOR `i'O INSTITUTE CIVIL ACTION AGAINST <br />C. L. DeLONG TRUCKING, INC. FOR NEGLIGENCE RESULTING IN EXTENSIVE <br />SEWER REPAIR, AND DECLA:KING AN EMERG~iCY. <br />WHEREAS, on or abant August 9, 1954, c. L. DeLong Trucking, Inc., by and. <br />through its agent, Allean C. Frederick, negligently permitted. tar to leak from its <br />truck into the sewers of the City of North Olmsted at Lorain and Dewey goads, <br />necessitating an extensive sewer opening and cleaning and purchase of material <br />amounting to a total of Five Hundred Sixty-One and 97.100 Dollars 0561.91), which <br />the trucking ceaapan3* has failed to reimburse the city for, <br />NOW, T~IEREP'ORE, BE 1T RESOLVED by the Council of the City of North Olmsted, <br />County of Cuvaho~a.. State of Ohio: <br />Section 1: That the Solicitor be authorized and he is hereby directed to <br />take the necessary legal steps to effect the collection of damages to the property <br />of the City of North Olmsted occasioned by the negligence of C. L. DeLong Trucking, <br />Inc., which negligence resulted from the leaking of tax from the company's truck <br />into the sewer of the city at Lorain and Dewey Roads, requiring the expenditure of <br />Five Hundred Sixty-One and 91100 Dollars 0 561.91) for labor and material in the <br />cleaning and repairing of the same, which negligent act occurred August 9, 1954. <br />Section 2: Wherefore, this Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public welfare of the City of <br />North Olmsted in that efforts should be immediately taken to reimburse the city for <br />its loss occasioned by the negligence of C. L. DeLong Trucking, Inc. in blocking the <br />sewer at Lorain and Dewey Roads on August 9, 1954, prior to the expiration of the <br />Statute of Limitations permitting the recovery of the damage due to said negligence. <br />Section 3: Wherefore, this Resolution shall take immediate effect from <br />and after its passage, otherwise, at the earliest period allowed by law. <br />Passeds Y%~~ A:~ieG~K. ~f _ ~ 9 ~ ~a <br />ATTEST: <br />_ .._~. <br />~._ <br />CLERK.
