CITY OF NORTH OLMSTED RESJLUTION No, 62 By '`r _ A RESOLUTION GRANTING A NINETY DAY EXTENSION OF THE COMPLETION 17ATE OF A CONTRACT $ETWEEN THE CITY OF NORTH OLMSTED AND THE CRANO CONSTRUCTION COMPANY FURTHER DESIGNATED AS CONTRACT NO. 8 WHICH PRESENTLY EXPIRES ON AUGUST 30, 1962, AND DECLARING AN EMERGENCY WHEREAS, the present contract between the City of North Olmsted and the Crano Construction Company further designated as Contract No. 8 for the construction and installation of sanitary sewers bears a completion date of August 30, 1962; and t'VHER:AS, the completion of said contract has been delayed due to unavoidable conditions and plan revision; and Wi~IE2.EAS, the Director of Public Service of the City of North Olmsted and Floyd G. Browne and Associates, resident engineers, have both advised this Council that they approve said extension. NOW, THEREFORE, 3E IT RESOLVE? by the C~e~acil of the City of North Olmsted, State of Ohio: Section 1: That an extension of ninety days from the present completion date of August 30, 1962 to November 3G, 1962 of a contract between the City of North Olmsted and the Crano Construction Company for the construction and installa- tion of sanitary sewers (further designated as Contract No. 8) be and the same is hereby granted. Section 2: That this Resolution is hereby determined to be an emergency measure necessary for the preservation of the public health, safety and welfare, such emergency existing by virtue of the fact the failure to extend the contract promptly would. raise serious legal questions of the rights of the parties to said contract; ~tiFHEREFORE, this Resolution shall take effect and be in force immediately upon its passage, other- wise, at the earliest period allowed by law.
