<br />I <br />..i ~._Y--l'., <br />l .~ <br />CITY OF NORTH OLNISTED <br />ORI)I NANCE NQ. 6 2 ~, <br />By ~ ~~ <br />AN ORDINAI~ICE DETERMINING TO 1'ROCE.ED WITH THB <br />CONSTRUCTION OF A STORE/i SE'6dEt: IN DECKER ROAD, <br />AND DECLARING AN EMERGENCY. <br />~3E IT ORr)A]:NEI) by the Council of the City <br />of North Olmsted, State of Ohio: <br />Section l: That it is hereby determined to proceed <br />with the installation and construction of a storm sewer in <br />Decker Road in the City of North Olmsted from the southerly <br />line of Sublot 396 to Southern Avenue pursuant to Resolution <br />No. 62-53, passed April 10, 1962, and in accordance with the <br />plans, specifications, profiles and estimates heretofore <br />approved and now on file in the office of the Director of <br />Public Service, such plans and specifications being incorpora- <br />ted herein by reference and reference being made heretofore <br />for a statement of the character of the materials which may be <br />bid upon for such improvement. <br />Section 2: That the estimated assessments against each <br />lot or parcel of land to be assessed as prepared by the City <br />Engineer and heretofore filed with the Clerk of Council before <br />the passage of Resolution No. 62-53 in accordance with the pro- <br />visions of Revised Code Section 727.12, are hereby approved and <br />adopted, no claims for damages resulting from said improvement <br />and no objections to said estimated assessments having been <br />filed. <br />Section 3: That the whole cost of said improvement <br />shall be assessed upon the lots and lands bounding and abutting <br />upon the proposed improvement in proportion to the benefits <br />which may result from the improvement and which lots and lands <br />are hereby determined to be specially benefited by said i.m- <br />pro vement. <br />The cost of said improvement shall include the cost <br />of legal services and of obtaining an approving opinion, the <br />expense of preliminary and other surveys, of printing and <br />publishing the notices, resolutions and ordinances required, <br />the serving of said notices and the cost of construction, to- <br />gether with the interest on notes and bonds issued in anticipa- <br />tion of the collection of deferred assessments and other necessary <br />expenditures. <br />Section 4: That all the assessments so to be levied <br />shall be paid in ten annual installments, with interest on de- <br />ferred payments at the same rate as shall be borne by the bonds <br />to be issued in anticipation of the collection thereof; provided, <br />however, that ~y such assessment in the amount of Five ($5.00) <br />Dollars or less, shall be paid in full, and not in installments, <br />at the time when the first or next installment would otherwise <br />become due and payable; provided, further, that the owner of any <br />property assessed may, at his option, pay such assessment in cash <br />within thirty (30) days after the passage of the assessing <br />ordinance. <br />
