<br />AN ORDINANCE LEVYING SpECIAL ASSESSMENTS FOR. THE
<br />IMPROVFMENT OF MASTICK ROAD AND CERTAIN OTHF,R
<br />STREETS OF THE CITY BY CONSTRUCTING SANITARY
<br />SEtn1ERS, AND DECLARING AN EMERGENCY.
<br />BE IT OR.DAINED by the Council of the City of Nortn Olmsted,
<br />Cuyahoga County, Ohio:
<br />Section 1. That the revised assessment of the cost and
<br />exoense of improvinp Mastick Road, Columbia Road, Carey. Lane,
<br />Allend.ale R.oad, Kennedy Ridge Road, Butternut Ridge Road, Canterbury
<br />Road, Louis Drive, Fitch Road, Burns Road, porter Road, Decker Road,
<br />Southern Avenue, MacKenzie Road, Stearns Road, Barton Road, and an
<br />easement parallel to Lorain Road bv constructing sanitary sewers and
<br />necessary appurtenances between the termini set forth in Resolution
<br />No. 64-254, adopted October 20, 1964, amounting in the aggregate to
<br />$1,016,435.99, as reported to this Council on the _I_2 p_ day of January,
<br />1967, by Floyd G. Browne & Associates, Ltd., Consulting Engineers of
<br />this City, and now on file in the of.fice of the Clerk of this Council,
<br />be and the same is hereby'adopted and confirmed and that there be and
<br />are hereby levied and assessed unon the lots and lands boundinQ and
<br />abutting upon said improvement the several amo,unts reported as afore-
<br />said,"which assessments are in proportion to the special benefits and
<br />are not in excess of any statutory limitation.

<br />Section 2. That this Council hereby f_inds and determines that
<br />the revised assessments as now on file in the office of said Clerk of
<br />Council are in the same amount as the original estimated assessments,
<br />Council havinQ determined that the City will assume as Part of_ its share
<br />of the cost of the.improvement the amount by which the final cost
<br />exceeded the original estimated cost of the improvement.
<br />Section 3. That the assessment against each lot or parcel of
<br />land shall be payable in cash within thirty days after the passage of
<br />this ordinance or at the option of the oT,aner in forty semi-annual
<br />installments with interest at the same rate as shall be borne by the
<br />bonds to be issued in anticipation of the collection of the same. All
<br />cash payments shall be made to the Director of Finance of this City.
<br />All assessments and installments thereof reMaining unpaid at the expira-
<br />tion of said thirty days shall be certified by the Clerk of_ this Council
<br />to the Countv Auditor as provided by law to be placed by him on the
<br />tax duplicate and collected as other taxes are collected.
<br />Section 4. That the Clerk of this Council shall cause a notice
<br />of the passage of this ordinance to be published once in a newspapeF of
<br />general circulation in this City and to continue,on file in her office
<br />said revised assessments.
<br />Section 5. The Clerk of this Council is hereby directed to
<br />deliver a certified cony of this Ordinance to the County Auditor within
<br />twenty days after its passage.
<br />Section 6. This ordinance is hereby declared to be an emergency
<br />measure necessary for the immediate preservation of the public peace,
<br />health and safety of said Cit_y and for the further reason that the imme-
<br />diate levy of such assessments is necessary to permit bonds to be issued
<br />to fund an outstanding note of the City and thereby preserve the credit
<br />of the CitysWHEREF(1RE, this Ordinance shall be in full force and effect
<br />from and after its passage and anProval by the Mayor.
