AN ORDINANCE DETERMINING TO PROCEED WITH THE OON3TRUC+ TION OF SANI?ARY SEWER3 AN D APPURI'ENANCES IN MA.STICK ROAD AND OTHER STREETS DE3IGNATED IN SECTION 1 OF RESOLUTION NO. 64-254, AND DECLARING AN EMERGENCY ? BE IT ORDAiNED by the Council of the City of North Olmsted, Ohio: Section 1. That it is hereby detecmined to proceed with the construction of sanitaty sewers and appurtenances in Mastick Rned and other Streets designated in Section 1 of Resolution No. 64-254. Section 2: That said improvement shall be mede in accord- ance with the provisions of Resolution No. 64-254 passed on October 20, 1964, and with the plans, speciffcations, estimates and profiles heretofore approved and now on file in the office of the Cleiic of this Council. 3ection 3: That all claims for damaqes resultinq therefrom that have been leqally filed shall be inquind into after completion of the proposed improvement, and the Dlrector of Law is hereby authorized and direct to institute leqal proceedinqs in a court of competent iurisdiction to inquire into claims that have been so filed. ? Section 4. That poRion of the cost provided in the above- mentioned resolution of necessity to be assessed shall be assesssd in the manner and the number of installments provided in said resolution and on the lots and lands described therein. % Section S. That the estimated assessment8 heretofore pre- pared and filed in the office of the Clerk of Council and as equalized by the Board heretofore appointed for such purpose by Resolution No. 64-282 adopted on November 17, 1964, the report of which Board was approved by Resolution No. 64-30'L adopted December 1, 1964, be and the same ar8 heraby adopted. Section 6. The Clerk of Council is hereby directed to deliver a certified oopy of this ordinance to the County Auditor within fifteen days after its passage. Section 7. Subiect to the provisions of Section 727.24, Revised Code, the Mayor of the City is hereby authorized and directed as ? soon as the funds therefor are available to make and-execute and vontract for said improvement with the lowest and best bidder after advertisinq accordinq to law and the improvement shall be financed as provided in the resolution of necessity. • Section 8.
