M CITY OF NORTH OLMSTED RESOLUTION NO. 64' BY ? A RESOLUTION AUTHOIaZING THE MAYOR TO DEED THE WATER MAIN EASEMENT IN THE PROPOSED WALDO' S • SUBDqVISION TO THE ORIGINAL C3RANTORS. AND DECLARING AN EMERGENCY. WHEREAS, by Resolution No. 63-162 the Council of the City of Nocth Olmsted approved a plat, for recordinq purposes only, of Waldo's Subdivision; and WHEREAS, said plat of Waldo's Subdivision was recorded by the Cuyahoga County Recorders; and WHEREAS, by Resolution No. 63-167, Walter and Lottie Pelech, owners of Waldo's Subdivision, deeded to the City of North Olmsted a perpetual water main easement in the proposed Waldo's Subdivision, and WHEREAS, the aforesaid water line easement was filed for • record with the Cuyahoga County Recorder; and WHEREAS, the owners of the property known as Waldo's Subdivision, Walter and Lottie Pelech, have naw discarded all plans for ? Waldo's Subdivision and wish to build a qarderrtype apartment instead of Waldo's Subdivision; and WHEREAS, said apartment building makes the aforesaid water line easement unnecessary for the purposes of the City of North Olmsted, and WHEREAS, the Council of the City of Nocth Olmsted naw wishes to approve the garden-type apartment building and to divest themselves of the water line easement. NOW, THEREFORE, -BE IT RESOLVED by the Council of the City of Nocth Olmsted, State of Ohio: Section 1: That the Mayor is hereby authorized to deed to Walter and Lottie Pelech,by quit claim deed, the water line easement previously • deeded to the City of North Olmsted by the aforesaid Walter and Lottie Pelech. Section 2: That Resolution No. 63-162 and Resolution No. 63-167 and any resolution or ordinance or parts of resolutions or ordinances inconsistent herewith are hereby repealed effective with the effective date of this Resolution.
