,. . , CITY OF NORTH OLMSTED ORDINANCE NO. 64- BY ° AN 'ORDINANCE AMENDING 64-55 , ENACTED MARCH 3, 1964, AMENDING ORDINANCE NO. 2796 ENACTED JANUARY 6, 1959 AND ENTITLED AN ORDINANCE VACATING PORTIONS OF AMBOUR DRIVE IN THE OHIO SHORES CON- STRUCTIUIN CORPORATION SUBDIVISIONS NO. 1, 2 and 3, AND DECLARING AN EMERGENCY . WHEREAS, Council by Ordinance 64-55 amended Ordinance No. 2796 which ordinance purported to vacate portions of Ambour Drive in Ohio Shores Subdivision lvTos. 1, 2 and 3, and which amending Ordinance, 64-55, was passed during a time that land of abutting property owners was being transferred to new owners, and WHEREAS, Council determined that the new owners should consent to the vacation of poctions of Ambour Drive and therefore it became necessary that the ordinance vacating portions of Ambour Drive be passed subsequent to the signing of the consent by the abutting property owners. WHEREAS, Council has heretofore enacted the above ordinance No. 2796 which ordinance purported to vacate portions of Ambour Drive in ? Subdivisions Nos. 1, 2 and 3, and WHEREAS, it was the intention of Council to vacate only portions of Ambour Drive situated in the Ohio Shores Construction Corporation Subdivisions No. 1 and 2, and WHEREAS, The Council of the City of North Olmsted has approved • for filing said developer's subdivisions No. 1, 2, 3, 4 and 5 and that at the time of approving for filing said developer's proposed subdivision No. 5, it was determined that said plat for subdivision No. 1 and 2 for proposed Ambour Drive included temporary cul-de-sacs at the westerly terminus of each of said subdivisions which extended beyond the sixty-(60) foot right of way for Ambour Drive required under the ordinances, and WHEREAS, it has been determined that portions of the cul-de- sacs as indicated in the Ohio Shores Construction Corporations Subdivisions No. 1 and 2 are to be abandoned, and WHEREAS, the owners of the property abutting the aforesaid cul-de-sacs in Ohio Shores Construction Corporation Subdivisions No. 1 and 2 have requested and consented to the Council of the City of North Olmsted, a copy of said consent being a part of the permanent records of the City of North Olmsted, adopting the necessary legislation abaridoning that portion of the aforesaid cul-de-sacs adjacent to their property and thereby permitting said abandoned property to revert to the abutting property owners in order that Ambour Drive will be a sixty (60) foot road westerly from Clague Road to its westerly terminus, and WHEREAS, the property description in ordinance No. 2796 enacted January 1, 1959, was incorrect in that it did not express the intention of Council of the City of North Olmsted and Council of the City of North Olmsted hereby wishes to correct said property description,
