,. . , <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 64- <br />BY ° <br />AN 'ORDINANCE AMENDING 64-55 , ENACTED MARCH 3, <br />1964, AMENDING ORDINANCE NO. 2796 ENACTED <br />JANUARY 6, 1959 AND ENTITLED AN ORDINANCE VACATING <br />PORTIONS OF AMBOUR DRIVE IN THE OHIO SHORES CON- <br />STRUCTIUIN CORPORATION SUBDIVISIONS NO. 1, 2 and <br />3, AND DECLARING AN EMERGENCY <br />. WHEREAS, Council by Ordinance 64-55 amended Ordinance No. <br />2796 which ordinance purported to vacate portions of Ambour Drive in Ohio <br />Shores Subdivision lvTos. 1, 2 and 3, and which amending Ordinance, 64-55, <br />was passed during a time that land of abutting property owners was being <br />transferred to new owners, and <br />WHEREAS, Council determined that the new owners should <br />consent to the vacation of poctions of Ambour Drive and therefore it became <br />necessary that the ordinance vacating portions of Ambour Drive be passed <br />subsequent to the signing of the consent by the abutting property owners. <br />WHEREAS, Council has heretofore enacted the above ordinance <br />No. 2796 which ordinance purported to vacate portions of Ambour Drive in <br />? Subdivisions Nos. 1, 2 and 3, and <br />WHEREAS, it was the intention of Council to vacate only <br />portions of Ambour Drive situated in the Ohio Shores Construction Corporation <br />Subdivisions No. 1 and 2, and <br />WHEREAS, The Council of the City of North Olmsted has approved <br />• for filing said developer's subdivisions No. 1, 2, 3, 4 and 5 and that at the <br />time of approving for filing said developer's proposed subdivision No. 5, it <br />was determined that said plat for subdivision No. 1 and 2 for proposed Ambour <br />Drive included temporary cul-de-sacs at the westerly terminus of each of said <br />subdivisions which extended beyond the sixty-(60) foot right of way for Ambour <br />Drive required under the ordinances, and <br />WHEREAS, it has been determined that portions of the cul-de- <br />sacs as indicated in the Ohio Shores Construction Corporations Subdivisions <br />No. 1 and 2 are to be abandoned, and <br />WHEREAS, the owners of the property abutting the aforesaid <br />cul-de-sacs in Ohio Shores Construction Corporation Subdivisions No. 1 and <br />2 have requested and consented to the Council of the City of North Olmsted, <br />a copy of said consent being a part of the permanent records of the City of <br />North Olmsted, adopting the necessary legislation abaridoning that portion <br />of the aforesaid cul-de-sacs adjacent to their property and thereby permitting <br />said abandoned property to revert to the abutting property owners in order that <br />Ambour Drive will be a sixty (60) foot road westerly from Clague Road to its <br />westerly terminus, and <br />WHEREAS, the property description in ordinance No. 2796 <br />enacted January 1, 1959, was incorrect in that it did not express the <br />intention of Council of the City of North Olmsted and Council of the City <br />of North Olmsted hereby wishes to correct said property description,
