CITY OF NORTH OLMSTED <br />RESOLUTION NO. 65- <br />/ A <br />BY L? . ?_?(Yi D,4? <br />A RESOLUTION APPROVING THE SEWER CONTRACT <br />BETWEEN THE CITY OF NORTH OLMSTED AND THE <br />• . CUYAHOGA BOARD OF COUNTY COMMISSIONERS <br />FOR THE TOWNSHIP OF OLMSTED AND AUTHORIZING <br />THE MAYOR OF THE CITY OF NORTH OLMSTED TO SIGN <br />THE SEWER CONTRACT ON BEHALF OF THE CITY OF <br />NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council hae heretofore approved the Area 3L Sewer <br />Program and has authorized the letting of contracts and the construction of <br />same, and <br />WHEREAS, Area 3 Sewer plans were designed large enough with <br />the purpose in mind of furnishing sewer facilities to the residents of Olmsted <br />Township at a stipulated service charge, and <br />WHEREAS, the Cuyahoga Board of County Commissioners are <br />charged with the duty of protecting the health and welfare of reeidents of <br />Olmsted Township and are authorized to enter into contracts for the benefit <br />of residents of Olmsted Township, and <br />WHEREAS, the Cuyahoga Board of County Commissionera and <br />the Council of the City of North Olmsted have now arrived at an agreement <br />as to the services to be provided, the controls to be established, the charges <br />to be imposed and everything necessary for the City of North Olmsted to <br />provide sewer services to Olmsted Township residents. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: . <br />Section 1: That the Council of the City of North Olmsted having <br />been advised of the terms of the contract between the City and the Cuyahogs <br />Board of County Commissioners for the furnishing of sewer services to the <br />residents of the area of Olmsted Township as established by the map made a <br />part of the contract, and each member further being furnished a copy of said <br />contract and having read same hereby approves said contract, for the furniahing <br />of sewer services and authorizes the Mayor of the City of North Olmated to <br />execute on behalf of the City the contract and approve all the terms embodied <br />therein. <br />Section 2: That this Resolution is hereby determined to be an <br />emergency measure necessary for the preservation of the public health, <br />safety and welfare, such emergency existing by virtue of the immediate <br />need to start and continue sewer construction in the Area 3 Sewer Dietrict <br />for health purposes, WHEREFORE, this Resolution shall be in full force <br />Q and effect from and immediately after ita paesage and approval by the Mayor. <br />PASSED: <br />?l <br />A TE5T: - <br />Margaret .
