.?..v <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 78- ? 7,d <br />BY: ?• (21 <br />AN ORDINANCE AUTHORIZING THE CITY OF NORTH OLNISTED <br />TO ENTER INTO AN AGREDMENT WI'TH THE CITY OF FAIRVIEW <br />PARK WHERE IN THE C ITY OF NORTH OLMSTE.D I S TO SERVE <br />AS LEAD AGENCY IN THE APPLICATION AND OTHER NECESSAItY <br />MATTERS FOR A FEDERAL GRANT UNDER THE PROVISION S <br />OF THE WATER POLLUTION CONTROL ACT AMENM NTS OF 1972P <br />IN CONNECTION WITH IMPROVEMENTS AND ADDITIONS TO THE <br />TO THE WASTEWATER TREATMENT AND SANITARY SEWAGE <br />FACILITIES OF THE CITIES OF NORTH OLMSTED AND FAIRVIEW <br />PARK AS PART OF THE AREA KNOWN AS THE NORTH OLMSTED <br />FACILITY PLAN AREA AND DECLARING AN IIMERGENCY. <br />WIIEREAS, the Federal Water Poll.ution Control Act Amendments of 1972 <br />(PL. 92-500) provide for grants through the U. S. Environmental Pxotection <br />Agency for planning (Step 1), detailed design (Step 2) and construction (Step 3) <br />of waste treatment works; and <br />Wf-IEREAS, the City of North Olmsted is being considered as a single entity <br />for purposes of priority ranking and federal funding and did receive priority nwnber <br />217 on the Ohio EPA Priority List for Construction Gxants dated May 25, 1978; and <br />WHEREAS, sections of incorporated areas in the City of Fairview Park <br />are tributary to and served by the municipal sewer systems; and <br />WHEREAS, the City of North Olmsted promises and agrees to incorno,rate <br />the area within the corporate limits of Fairview Park in the study area for <br />Facilities, Planning (including infiltration/inflow analysis, and sewer system <br />evaluation. <br />NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY 0F CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City pf North Olmsted will paxticipate in the implementa- <br />tion of a Facillties Plan and that the Mayor be and he is hereby directed to enter <br />into an agreement with the City of Fairview Paxk in the filing of an application <br />and other necessary matters as required to secure federal grants under the Water <br />k'ollution Control Act Amendments of 1972 as the initial step in developing the <br />Facilities Plan. <br />SECTION 2: That in order to preserve the public peace, health and safety <br />and in or er to expedite the filing of the aforementioned application for federal <br />grants, an emergency is hereby found to exist and this Ordinance is declared <br />to be an emergency measuxe and shall take e£fect imediately upon its passage and <br />approval provided it receives the affirmative vote of two-thirds of all members <br />elected to Council and approval by the Mayor. <br />PASSED : d?9 <br />ATTEST <br />/-2-- ?F <br />,??'ti?
