? <br />ORDINANCE N0. 78-/,Zf <br />BY: <br />AN ORDINANCE AMENDING CHAPTER 149 OF TI-IE CODIFIED <br />ORDINANCES OF TF-lE CITY OF NORTH OLM.STED ENTITLED <br />"PLANNING COMI`1ISSION" BY ADDING A NE4!! SECTION <br />149.02 ENTITLED "NOTICE OF PLANNING CONMISSION <br />MEETINGS". <br />WHEREAS, it is the desire of this Council that area residents be <br />notified of proposed subdivisions and development projects that affect their <br />property, and <br />WIEREAS, it has been determined that the best way to make residents <br />aware is by official notification. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNT'Y OF CUYAHOGA AND STAT'E OF OHIO: <br />SECTION l: That Cha.pter 149 of the Codified Ordinances of the City <br />of North Olmsted entitled "Planning Commission" be amended by adding thereto a <br />new Section 149.02 entitled "Notice of Planning Comunission Meetings" which new <br />Section shall read as follows: <br />"149.02 NOTICE OF PLANNING COMMMISSION MEETINGS. <br />A. The Secretary of the Planning Comonission shall be required to <br />send notification of Planning Comission meetings giving the time, <br />date, and subject matter of the meeting to the independent record <br />title holder of property affected by any proposed subdivision or <br />development. <br />For the purposes of this Section those interested parties affected <br />by any subdivision or development shall be as follows: <br />(a) Those on the same side of the street which abut the <br />premises involved, and <br />(b) Those across the street inunediately opposite the premises <br />involved. <br />(c) Any other premises abutting the premises involved, and <br />(d) Such other premises as may be ordered to be notified by <br />rule or regulation of the Commission or by its special order. <br />B. The notice specified in Section A hereof shall be by regular <br />first class mail postage prepaid, ma.iled at least five (5) days <br />prior to the date of such meeting. <br />C. For purposes of this Ordinance Independent Record Title Holder <br />shall mean a person, who as disclosed by the records of the Auditor <br />of Cuyahoga County, is the owner at any date within sixty (60) days <br />of the date of such notice. Nothing herein provided shall be <br />construed as limiting the power of the Commission from enlarging on <br />such notice.
