? , ? ?_:. <br />CITY OF NORTH OLMSTED <br />ORDINANGE N0. 78-94 <br />By : <br />? <br />AN ORDINANCE PROVIDING FOR THE AMENDMENT <br />OF THE ZONE MAP OF THE CITY OF NORTH OLPISTED, <br />WHICH ZONE MAP IS PART OF THE ZONING CODE OF <br />THE CITY OF NORTH OLMSTED, BY CHANGING THE <br />PREMISES HEREINAFTER DESCRIBED FROM CLASS A <br />HIGH RISE RESIDENTIAL DISTRICT TO GENERAL <br />RETAIL BUSINESS DISTRICT. <br />WHEREAS, it appears that the zoning that applies to the below described <br />real property is improper under the conditions presently existing and inadequate <br />for the development and use of this land, and <br />WHEREAS, after a careful consideration, the Planning Commission of this <br />City, on the llth day of April, 1978, recommended approval of the change of the <br />district herein specified: <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That after submission of this Ordinance to the Planning <br />Commission of this City for its opinion and recommendation, and after a Public <br />Hearing hereon, notice of which has been given pursuant to Section 14 of <br />Article IV of the Charter of this City, entitled "The Council - Enactment of <br />Zoning Ordinances and Regulations, Notice", and after its passage pursuant to <br />the Charter of this City and its approvalby the Mayor of this City of North <br />Olmsted, the Zone Map of North Olmsted, is hereby amended, and as amended be <br />and the same is hereby revised by changing the zoning of the following described <br />parcel of land from Class A High Rise Residential District to General Retail <br />Business District: <br />Situated in the City of North Olmsted, County of Cuyahoga and <br />State of Ohio and known as being part of Original Dover Township <br />Lot No. 7 bounded and described as follows: <br />Beginning on the Southeasterly line of Lorain Road, 80 feet wide, <br />at the Northwesterly corner of the Kings Path Condominium as shown <br />by the plat recorded in Volume 14, Page 21 of Cuyahoga County <br />Condominium Records; Thence S. 20 27' 32" W., along a Westerly line <br />of said Kings Path Condominium, a distance of 438.73 feet to an <br />interior corner thereof; Thence No.870 32' 28" W., along a Northerly <br />line of said Kings Path Condominium, a distance of 177.34 feet; <br />Thence No. 20 27' 32" E., a distance of 328.16 feet to the South- <br />easterly line of Lorain Road; Thence No. 600 31' 00" E., along <br />the Southeasterly line of Lorain Road, a distance of 208.98 feet <br />to the place of beginning, be the same more or less, but subject <br />to all legal highways. <br />SECTION 2: That the Clerk of this Council be and she is hereby directed <br />to cause a notice of a Public Hearing hereon to be given pursuant to the provisions <br />of Section 14 of Article IU of the Charter of this City. <br />SECTION 3: That the Engineer of this City shall amend said Zoning Map of <br />North Olmsted so that when amended, said Zoning Map will disclose that the premises <br />described in Section I hereof shall be revised by changing the zoning of said <br />described land from Class A High Rise-ResadentYal Distri-ct tb-General Retail <br />Business District, and that said parcel of land may be thereafter used in accordance <br />with the use of the district permitted by the Zoning Code of the City of North <br />Olmsted.
