G1. ?/`,? <br />Ift, <br />AN ORDINANCE AUTHORIZING THE PAYMENT OF A <br />MORAL CLAIM TO KENNETH BISANTZ, THOMAS DET4ALINE, <br />AL CEPIC, AND KENNETH E. KLEM, EMPLOYEES OF THE <br />SERVICE DEPARTMENT OF THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, Kenneth Bisantz, Thomas Demaline, Al Cepic, and <br />Kenneth E. K?_em, are employed by the City of North Olmsted as mechanics <br />in the Service Department, and <br />WHEREAS, as mechanics, the aforesaid employees are required to <br />supply and use their own tools, and <br />WHEREAS, the Service Department garage was burglarized and <br />property of the aforesaid individuals was damaged and/or stolen, <br />and <br />WHEREAS, although the actual amount of loss has not been <br />determined with respect to each individual, the said employees claim <br />the following loss: <br />KENNETH BISANTZ $564.67 <br />THOMAS DEMALINE $719.00 <br />AL CEPIC $ 74.90 <br />KENNETH E. KLEM $299.97 <br />and, <br />WHEREAS, even though the City of North Olmsted has no obligation <br />to pay for the damages and/or losses sustained by each employee, the <br />City recognizes the moral obligation to pay for actual damages and/or <br />losses sustained by the respective parties. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Council does hereby authorize the payment <br />not to exceed the following, to each of the individuals listed herein <br />as a moral claim: <br />KENNETH BISANTZ $564.67 <br />THOMAS DEMALINE $719.00 <br />AL CEPIC $ 74.90 <br />KENNETH E. KLEM $299.97 <br />however, the authority to pay the moral claim shall be only the actual <br />damages and/or loss sustained which shall be determined by the Director <br />of Public Service, and shall not exceed the amounts specified herein. <br />The Director of Public Service, in determining the actual amount of <br />damage and/or loss sustained, shall take into consideration such things <br />as depreciation of equipment stolen and the cost of repairs to items <br />damaged. <br />SECTION 2: That the Director of Finance is hereby authorized <br />to pay amounts to the claimants specified herein, not to exceed the <br />limitations further specified herein and the moral claims shall be <br />paid only upon approval of the Director of Public Service.
