<br />ORDINANCE N0. 78-45

<br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER
<br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE
<br />DETACHED GARAGE ON PERMANENT PARCEL N0. 235-16-36,
<br />LOCATED ON BURNS ROAD IN THE CITY OF NORTH OLMSTED,
<br />AND DECLARING AN EMERGENCY.
<br />WHEREAS, pursuant to the provisions of Chapter 1331.01,
<br />specifically Paragraphs h, i, and j, of the Codified Ordinances of the City
<br />of North Olmsted, the Building Commissioner has determined that the detached
<br />garage on Permanent Parcel No. 235-16-36 located on Burns Road, North Olmsted,
<br />the record title holder, Henry Przybys, is unsafe, dangerous to human life
<br />and hazardous to the safety, health, and public welfare of the citizens of
<br />North Olmsted, Ohio, and
<br />WHEREAS, notice to repair, remove, and demolish said garage was
<br />served by registered letter on said record title holder on October 17, 1977,
<br />ordering said title holder to repair, remove, or demolish said garage and to
<br />commence such repairs, removal, or demolition within forty-eight (48) hours
<br />of said notice, and
<br />WHEREAS, said record title

<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTN
<br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO:
<br />SECTIOid 1: That Council deems it necessary to proceed with the
<br />demolition and removal of the detached garage on Permanent Parcel No. 235-16-36
<br />located on Burns Road, North Olmsted, Ohio, owned by Henry Przybys whose
<br />mailing address is 6085 Burns Road, North Olmsted, Ohio 44070, by reason of the
<br />fact that said detached garage has been determined to be dangerous to human
<br />life and a hazard to the public safety, health, and welfare of the citizens of
<br />the City of North Olmsted, and that the cost of said demolition and removal be
<br />paid from the General Fund of the City of North Olmsted, and charged to the
<br />owner as a special assessment or lien on said parcel of land, and assessed and
<br />collected in the manner of other assessments as provided by law.
<br />SECTION 2: That the Clerk of Council be, and she is, hereby directed
<br />to forward a copy of this ordinance to Henry Przybys, 6085 Burns Road, North
<br />Olmsted, Ohio 44070.
<br />SECTION 3: That this ordinance is hereby declared to be an
<br />emergency measure immediately necessary for the preservation of the public
<br />health, safety and welfare, and for the further reason that the condition is so
<br />adverse so as to constitute a detriment to human life and hazardous to the
<br />public safety, health and welfare of all of the citizens of North Olmsted, and
<br />further provided it receives the affirmative vote of two-thirds of all members
<br />elected to Council, it shall take effect and be in force immediately upon its
<br />passage and approval by the Mayor.
