<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 78-JJ <br />BY : >44,111- <br />A RESOLUTION EXPRESSING AN INTENT BY <br />THE CITY OF NORTH OLMSTED TO COOPERATE <br />WITH THE COMMISSIONERS OF CUYAHOGA COUNTY <br />CONCERNING MUNICIPAL SOLID WASTE DISPOSAL. <br />WHEREAS, the Commissioners of Cuyahoga County, Ohio, <br />have indicated an intention to act as the prime sponsor of a <br />resource recovery facility which would use, as its raw materials, <br />the solid waste generated in and by the municipality of North <br />Olmsted, and other municipalities in Cuyahoga County, Ohio, and <br />WHEitEAS, the creation of such a facility will require ex- <br />tensive technological, legal, financial and other planning by <br />the County for the benefit of the County and participating muni- <br />cipalities, and <br />WHEREAS, the feasibility of creating and operating such a <br />facility will depend on the long-term commitment of the municipal- <br />ities within Cuyahoga County to deliver adequate amounts of <br />processable solid waste to such a facility and in paying an adequate <br />and eQuitable fee for processing such solid waste, and <br />WHEREAS, the Commissioners of Cuyahoga County reauire formal <br />expressions of interest by those municipalities who wish to con- <br />sider long-term contracts, so that the Commissioners might determine <br />the feasibility of such a project before committing themselves to <br />extensive planning costs or contractual obligations. <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the City of North Olmsted expresses an <br />interest in considering a contract of at least twenty years <br />duration for the delivery of all the solid waste collected by <br />the Municipality or its contractee, now estimated to be at least <br />f'f teen tons per day, according to a fee schedule <br />to be etermine in the future, which fee schedule would permit the <br />timely retirement of indebtedness and payment of operating costs <br />arising from this project. <br />SECTION 2: That the Municipality hereby authorizes its <br />Mayor, on its e alf, to enter into discussions with representatives <br />of Cuyahoga County, Ohio, leading to an agreement subject to <br />approval of the City of North Olmsted by ordinance, to be entered <br />into between this Municipality and Cuyahoga County, Ohio, and/or <br />its designee, which agreement shall (a) provide for the aisposal <br />of all of this Municipality's solid waste, (b) provide for the <br />payment of this Municipality's service fees required in connection <br />therewith, (c) be in operation for a duration beginning with the <br />date of its execution and ending on the date to be set for the <br />retirement of the indebtedness arising from this project, (d) <br />provide a formula for service fees which takes into account the <br />debt service and operating costs arising from the project, and (c) <br />be conditioned upon the substantial completion of the project so <br />that it is able to receive solid waste for processing.
