CITY OF NORTH OLMSTED RESOLUTION N0. 78-JJ BY : >44,111- A RESOLUTION EXPRESSING AN INTENT BY THE CITY OF NORTH OLMSTED TO COOPERATE WITH THE COMMISSIONERS OF CUYAHOGA COUNTY CONCERNING MUNICIPAL SOLID WASTE DISPOSAL. WHEREAS, the Commissioners of Cuyahoga County, Ohio, have indicated an intention to act as the prime sponsor of a resource recovery facility which would use, as its raw materials, the solid waste generated in and by the municipality of North Olmsted, and other municipalities in Cuyahoga County, Ohio, and WHEitEAS, the creation of such a facility will require ex- tensive technological, legal, financial and other planning by the County for the benefit of the County and participating muni- cipalities, and WHEREAS, the feasibility of creating and operating such a facility will depend on the long-term commitment of the municipal- ities within Cuyahoga County to deliver adequate amounts of processable solid waste to such a facility and in paying an adequate and eQuitable fee for processing such solid waste, and WHEREAS, the Commissioners of Cuyahoga County reauire formal expressions of interest by those municipalities who wish to con- sider long-term contracts, so that the Commissioners might determine the feasibility of such a project before committing themselves to extensive planning costs or contractual obligations. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That the City of North Olmsted expresses an interest in considering a contract of at least twenty years duration for the delivery of all the solid waste collected by the Municipality or its contractee, now estimated to be at least f'f teen tons per day, according to a fee schedule to be etermine in the future, which fee schedule would permit the timely retirement of indebtedness and payment of operating costs arising from this project. SECTION 2: That the Municipality hereby authorizes its Mayor, on its e alf, to enter into discussions with representatives of Cuyahoga County, Ohio, leading to an agreement subject to approval of the City of North Olmsted by ordinance, to be entered into between this Municipality and Cuyahoga County, Ohio, and/or its designee, which agreement shall (a) provide for the aisposal of all of this Municipality's solid waste, (b) provide for the payment of this Municipality's service fees required in connection therewith, (c) be in operation for a duration beginning with the date of its execution and ending on the date to be set for the retirement of the indebtedness arising from this project, (d) provide a formula for service fees which takes into account the debt service and operating costs arising from the project, and (c) be conditioned upon the substantial completion of the project so that it is able to receive solid waste for processing.
