AN ORDINANCE TO VACATE A PORTIDN OF THE <br />NORTHERLY END OP' RAAtCHVIPW AVENUE AS SHOWN <br />BY DAN BENUSKA SUBDIVISION PLAT N0. 1. <br />Whereas, there has been filed with the Council an applica- <br />tion by Dan Benuska, to vacate the northerly end of Ranchview Avenue <br />as shown by Dan Benuska Subdivision Plat No. 1, and <br />Whereas the Council is satisfied that there is good cause <br />for vacating the portion of R,anchview Avenue hereinafter described, <br />and that it will not be detrimental to the general interest and ought <br />to be made. <br />THEREFORE, BP IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, OHIO: <br />Section 1 That all that part of Ranchview Avenue in the <br />City of Nort mated, Ohio, bounded and described as follows: <br />Situated in the city of North Olmsted, County of Cuyahoga <br />and State of Ohioi and known as being part of Original Dover <br />Township lot Number ? and being further known as the Northerly <br />portion of Ranchview Avenue as dedicated and shown on record <br />plat of the Dan Benuska Subdivision as recorded in Volume 146, <br />page ~.0 of Cuyahoga County records, and being further described <br />as follows: <br />Beginning at the east line of 8anchview Avenue at its <br />intersection w~th the north line of said Dan Benuska Subdivision <br />thence South 2 2$' 00" West along the said East line of Ranch- <br />view Avenue 1.9.$1 feet to a point, thence along a curve deflect-~ <br />ing to the left and having a radius of 47.49 feet and a chord <br />bearing South 5?0 24f 43" West a distance of 29,03 feat to a <br />point of tangency, thence South 740 56~ 21" East 6.64 feet to a <br />point of curvature deflecting to the right and having a radius <br />of 47.49 feat and a chord bearing South 57 24' 43" West a diz- <br />tance of 29.03 feet to the West line of said Ranchview Avenue, <br />thence North 2° 2$~ 00" Lust along said West line of Eanchviaw <br />Avenue 16$.11 feet to North line of said Dan Benuska Subdivision, <br />th®nce South $9 3?' 40" East 60.04 feet to the place of begin- <br />ning be the same more or less but subject to all legal highways. <br />be and the same is hereby vacated. <br />Section 2 That the Clerk b® and he is hereby directed to <br />notify the u itor of Cuyahoga County of the vacation of said portion <br />of Ranchview Avenue herein described by sending him a copy of this <br />ordinance. <br />Sectio,~a 3. This ordinance is hereby declared to be an emer- <br />gency measure, the emergency being that it is necessary for the immediate <br />preservation of public healthy peace, safety and welfare that this ord- <br />inance be passed at once, and to vacate a portion of a City street, and <br />shall take effect and be in fore from and after its pas$age. <br />PASSED: September 21, 1954. <br />ATTEST• <br />,~ <br />E.
