QRD INANCE N0 . 9 q / <br />BY: i~'~%~/,~~Gr ~ ©RDINA1dCE DETERMINING TO Pa.iJCEEI} WITH <br />THE I~PH.OVEt~EI~T OF ~~API.E RSDGS xOAD FRt~ <br />CLAt~tTE BaAD TO i~ALTBR BQAD BY GlJNSTRU C'~ION <br />OF A Ca~dC&E`TE WALK t3N THB NCR~'FTF~RLY SIDE <br />QF ~IApLE RIDGE ROAD <br />BE IT ORDAINED BI' THE COUNCIL OF THE CITY OF N©RTH OLMSTED, <br />STATE OF OHIO: <br />S~gctiolr~ That it is hereby determined to proceed with the <br />i~prove~ast ofi plc 8idge Road from Claque Aoad to Y~al~er Road by <br />construction of .a concrete walk on the northerly side of 1-~ap1e ridge <br />Road, in accordance with Resolution No. 1~? passed en the 5th day of <br />August, 1952, and the petition of property owners described in said <br />Resolution and in accordance with the plans, specifications, esti- <br />mates sad profiles heretofore appre>ved and now on file in the office <br />of the Director of Public Service. <br />Section 2. That all claims for damages resulting therefrom <br />shall be ~~dicially inquired into after the completion of the pro- <br />posed improvement, and the solicitor be, and he is hereby authorised <br />and directed to institute proceedings in a court of competent ~uris- <br />diction to inquire into such clai.~ns. <br />S~ That the cost of said i~tprovement shall be assessed <br />by the ®ot front upon the following described 10ts aad leads, to ~ti.t, <br />all lots ar~d lands bounding and abutting upon the proposed #~ggr©vsment, <br />which said lots and lands are hereby determined to be specially bene- <br />fited by said improvement; and the cost of said improvement shall in- <br />clude the expense of preliminary and other surveys, of printing and <br />publishing the notices, resolutions and ordinances required, the serv- <br />ing of said notices, the cost of construction, together with interest <br />on notes or bonds issued in anticipation of collection of deferred <br />assessments and all other necessary expenditures. <br />Section l+. That the assessments 'so to be levied shall be paid <br />in five annual installments, with interest not to exceed six per cent <br />per annum on deferred payments, provided that the owner of any pro- <br />perty assessed may, at his option, pay such assessment in cash within <br />thirty daps from and after the passage of the assessing ordinance, in <br />which case said assessment shall not include a~ay item of interest upon <br />notes or bonds to be issued in anticipation of the emllection of <br />deferred installments of assessments. <br />Suction 5. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of .the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6 That the City Engineer be and he is hereby directed <br />to prepare and~`#le with this Council a tentative assessment showing <br />the amount to be assessed on each lot or parcel of land to be assessed. <br />Section 7. That the Director of Public Service be, and he is <br />hereby authorised and directed to advertise for bids for the construc- <br />tion of said improvement according to law. <br />Section ~.
