CITY OF NORTH OLMSTED <br />ORDINANCE No. 63-123 <br />,, -> <br />By - ~-~~~.• ,~r~a ~t~+~c~,,~,. <br />i <br />AN ORDINANCE AUTHORIZING THE ACGBPTANCE BY THE <br />CITY OF AN EA~SMBNT OVER THE PROPERTY OF <br />MURIEL G. GRUHAUGH AND ROY F. GRUBAUGH FOR USE <br />"` IN CONNECTION WITH THE ALBX,ANDBR ROAD NORM <br />SEWER AND PROVIDING PAYMENT THEREFOR, AND DE- <br />GLARING AN EMERGENCY. <br />WHBREAS, the construction of a storm sewer in the <br />Alexander Road District requires that an easement ®ver the <br />property of Muriel G. Grubaugh and Roy F. Grubaugh be obtained; <br />and <br />WHBREAS, said Muriel G. Grubaugh and Roy F. Grubaugh <br />have naw executed an easement in writing, a copy of which is <br />attached hereto and made a part hereof as if fully rewritten; <br />and <br />WHEREAS, payment for said easement in the amount of <br />X1,625.00 has been determined by this Council to be reasonable <br />and necessary. <br />NOW, THEREFORE, BE IT ORDAINED bq the Council of the <br />City of North Olmsted, Mate of Ohio. <br />Section 1: That this Council hereby determines <br />that it is necessary in connection with the construction of a <br />storm sewer on part of Alexander Road in the City of North <br />Olmsted to accept fr©m Muriel G. Grubaugh and Roy F. Grubaugh <br />an easement over part of their land, part of which shall be a <br />permanent easement for the installation and maintenance of a <br />storm sewer and part of which shall be a temporary easement for <br />construction purp©ses, both of which easements ire described <br />in detail by metes and bounds in the attached easement which is <br />made a part hereof by reference. <br />Section 2. That in payment for said easement the <br />Director of Finance be and he is hereby authorized to disburse to <br />Muriel G. Grubaugh and Roy F.
