CITY OF NORTH OLM~TED Ordinance No. 63 -~ %~' aN ORDINANCE LEVYING SPECIAL ASSESS~'~~iE4~iTj FOlt THE IMPROVEMENT OF 6VAL'TER ROAD IN THE CITY OF NORTH OLMSTED FRO~~1 THE INTERSECTIJ:~ OF WALTER ROAD Ai'VD .,, BEECH LANE NORTD T°:~ T:~fE NORTHERLY CvRI'ORATE LINE OF T}}E CITY, A~TDD :DECLARING AN EMERGENCY, :..~ V+1?iEREA5, the .Engineer of this City has certified that the improvement of ENalter Road in the City of North Olmsted by the construction and installation of a water line therein from the intersection of +~alter Road and Beech Lane north to a point approximately nine hundred (900) feet beyond the northerly cor- porate line of the City to the terminus of a pre-existing water line in the City of t^Jestlake, Ohio, as set fortlh. in Resolution No. 62-17 adopted by this Council on Februaxy 20, 1962, and Ordiance i'Vo. 62-t?3, enacted May 1S, 1962, has been completed pursuant to specifications and contract and that said water line has been accented by this Council and the }3irector of T'ublic Service; and ~nl}-ERF;AS, by the terms of Resolt~t i on fit-17 that ~a rt of the water line lying ox:tside the corporate limits of North Jlmsted (in the City of Westlake, Ohio) was therein deter°~ined to be one-half of the total cost and expense of said improvement and for that reason determined to be the City's t~ortion of the cost and expense of the entire improvement; and WI}FxtFAS, the total cost and expense of the entire improvement has been ascertained to be $9,675.65, and one-half thereof, to-wit: $4,n37.R2 to be the portion which is to be paid for by special assessments on t}~e lands bounding and abutting upon said improvement in tl~e City of North Olmsted. NOW, THi~N,EFORE, E3E IT ORDAINED by the Council of the City of North CJlmsted, State of Ohio: Section 1: That tt?.e revised assessment of the cost and expense of improving Walter Road in the City of North tJlmsted by the installation and construction therein. of a water line pursuant to Ordinance No. 62-83, enacted May 15, 1962, as reported to this Council on the 15th day of May, 1963, and amounting a.n the agregate to $4,83'7.2 is the portion thereof to be paid for by special assessments, and now on file in the office of the Clerl~ of Council, be and the same is hereby adopted anal confirmed and that there ire and are hereby levied and assessed upon the lots and lands bounding and abutting upon said improvement in the City of North Olmsted the several amounts reported as aforesaid, which assessments are in proportion to the special benefits and are not in excess of any statutory limitation. Section 2: That the Council hereby finds and determines that the revised assessments a~~ now on file in the office of said Clerk are in the same proportion to the estimated assessments as originally filed as the actual cost of the above described improve- ment is to the estimated cost of the imt~rovement as originally filed. Section 3: That the assessment against each lot or parcel of land shall be payable in cash within thirty (30) days from and after the passage of this Ordinance or, at the option of the owner, in ten annual installments wit}~ interest at the same rates as shall be borne by the bonds to be issued in anticipation of the collection of the same.
