CITY OF NORTH OL~ISTED <br />OR'~INANCE No. 63 ~-~ //~ <br />DY .~ <br />AN ORDINAivCE LEVYING SP;k:ClAL ASST:SSi~~i:l~~v'TS FO~t THE <br />IMPROVE~~iENT OF DECKER R(JAD FROM THE SUUTIIERI.Y LI:'3E <br />OF SU13Lt~T 396 TO SOUTHERN AVENUE IN TFiE CITY Op <br />z~..,- NORTH OLMS'I'ED ~3Y TTiE INSTALLATION .ANI~ CONSTRUCT~:JN <br />CAF A STORM SEt~ER, AND DECLARING AN E:~IERGEI~iCY. <br />AE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio: <br />Section 1: That the revised assessment of the cost <br />and expense of improving Hecker Road in the City of North ~~lmsted <br />by the installation and construction therein of a storm sewer <br />pursuant to Ordinance No. 62-53 passed by this Council on J~prit"'1Q, <br />1962, as amended by Ordinance No. 62-181, passed by this Council <br />on October 16, 1962, as reported to this Council on May 15, 1963, <br />amo??ntina in the aggregate to .11,122.69 and now on file in the <br />office of the Clerk of Council, be and the same is hereby adopted <br />and. confirmed and that there be and are hereby levied and assessed <br />upon the lots and. land. bounding and abutting t±pon said improvement <br />the several amounts reported as aforesaid, which assessments are in <br />pooportion to the special benefits and are not in excess of any <br />statutory limitation. <br />Section 2: That the Council hereby finds an c. determines <br />that the revised assessments as now on file in the office of said <br />Clerk are in the same proportion to the estimated assessments as <br />originally filed as the actual cost of the above described. improve- <br />ment is to the estimated cost of the improvement as originally filed. <br />Section 3: That the assessment against each lot or <br />parcel of land shall be payable in cash within thirty (30) days <br />from and after the passage of this Ordinance or, at the option of <br />the owner, in ten annual installments with interest at the same rates <br />as shall be borne by the bonds to be issued in anticipation of the <br />collection of the same. A11 cash payments shall be made to the <br />Director of Finance of the City of North Olmsted. All assessments <br />and installments thereof remaining unpaid at the expiration of <br />thirty (30) days shall becertified by the Clerk of this Council <br />to the County Auditor as r~rovided by law to be '~y him extended <br />on the tax duplicate and collectec?. as other taxes are collected. <br />Section 4: That the Clerk of Council shall cause <br />a notice of the passage of this Ordinance to be published once <br />in a newspaper of general circulation in this City and to continue <br />~ on file in his office said revised assessments. <br />Section 5: That the Clerk of Council is hereby <br />directed. to deliver a certified copy of this ~.3rdinance to 1;he <br />County Auditor within twenty C20) days after its passage. <br />Section 6: That this Ordinance is hereby declared to <br />be an emergency measure necessary for the immediate preservation <br />of the public peace, health, safety and welfare by virtue of the <br />fact that its immediate t~assa~e is necessary so that bonds may be <br /> <br />
