<br />AN ORDINANCE VACATING PROPERTY CONVEYED TO THE CITY
<br />OF NORTH OLMSTED BY THE LEELAND SUBDIVISION, PLAT
<br />NUMBER 3 AN D RECORDED IN VOLUMB~' 165 , PAGE 35 , OF
<br />CUYAHOGA COUNTY RECORDS, AND DECLARING AN EMERGENCY.
<br />WHEREAS, on April 10, 1957, C & K Builders dedicated
<br />to the City of North Olmsted, certain lands for street purposes, and
<br />WHEREAS, by virtue of Ordinance 2474, enacted April 27,
<br />1957, the Council of the City of North Olmsted approved for record purposes only
<br />the Leeland Subdivision Number 3, and
<br />WHEREAS, C & K Builders were the owners and developers of
<br />Leeland Subdivision No. 3, and
<br />WHEREAS, the land dedicated for street purposes was trans-
<br />ferred May 20, 1957 and was accepted for recording by the Cuyahoga County
<br />Recorder on May 20, 1957, and recorded in Volume 165, Page 35 of Cuyahoga
<br />County Records , and
<br />WHEREAS, the lands dedicated to the City of North Olmsted
<br />have been known as West 230th Street in the City of North Olmsted, and
<br />WHEREAS, said lots 31 to 34 inclusive have been purchased
<br />by George and Rita Welsch who are now the sole owners of all lands in sublots
<br />31 to 34 inclusive which extends from the Southerly line of Sublot 35 to the Southerl
<br />line of Leeland Subdivision No. 3, and
<br />WHEREAS, it is the intention of Council to vacate the portions
<br />of land dedicated to the City of North Olmsted by the plat recorded in Volume
<br />165 , Page 35 , of the Cuyahoga County Recorder , and
<br />WHEREAS, George and Rita Welsch the sole owners of the land
<br />abutting the portions of the street, known as West 230th Street, North Olmsted,
<br />Ohio have consented to accept the vacated portions of the street, and
<br />WHEREAS, a copy of said consent is attached hereto and made
<br />a part of this Ordinance.
<br />NOW, THEREFORE, BE IT ORDAINS D by the Council of the
<br />City of North Olmsted, Ohio:
<br />Section 1: That this Council does hereby vacate that portion
<br />of West 230th Street within the City as are described as follows:
<br />Situated in the City of North Olmsted, County of Cuyahoga
<br />and State of Ohio: and known as being that part of West
<br />230th Street extending Southerly from the Westerly prolongation
<br />of the Southerly line of Sub Lot No. 35 to the Southerly line
<br />of the C and K. Builders Inc. , Leeland Subdivision No. 3 of
<br />part of Original Dover Township Lot No. 40 as shown by the
<br />recorded plat in Volume 165 , Page 35 of Cuyahoga Count
<br />Records as appears by said plat, be the same more or less,
<br />but subject to all legal highways .
