<br />~c~_f~,q <br />CITY OF NORTH OLMSTED <br />C}RDtI~TAOEu NO. 64- Sjf! <br />BY <br />AN ORDINANCE AMENDING ORDINANCE NO. 2796 ENACTED <br />JANUARY 6, 1959 and ENTITLED AN ORDHdANCE VACATING <br />PORTIONS OF AMROUR DRIVE IN THE OHIO SHORES CONSTRUCTIOr <br />CORPORATION SUBDM~ONS NO. 1, 2 and ~, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, Council has heretofore enacted the above ordinance <br />No. 2696 which ordinance purported to vacate portions of Ambour Drive in <br />Subdivisions No . 1, 2 and 3 , and <br />WHEREAS, it was the intention of council to vacate only <br />portions of Ambbur Drive situated in the Ohio Shores Construction Corporation <br />Subdivisions No. 1 and Z, and <br />WHEREAS, the council of the City of North Olmsted has <br />approved for filing said developer's subdivisions No. 1, 2, 3,4, and 5 <br />and that at the time of approving for filing said developer's proposed sub- <br />division No. 5 , it was determined that said plat for subdivision No. 1 and <br />2 for proposed Ambour Drive included temporary cul-de-sacs at the <br />westerly terminus of each of said subdivisions which extended beyond <br />the sixty (60) foot right of way for Ambour Drive required under the <br />ordinances, and <br />WHEREAS, it has been determined that portions of the cul-de- <br />sacs as indicated in the Ohio Shores Construction Corporations Subdivisions <br />No. 1 and 2 are to be abandoned, and <br />WHEREAS, the owners of the property abutting the aforesaid <br />cul-de-sacs in Ohio Shores Construction Corporation Subdivisions No. 1 <br />and 2 have requested and consented to the council of the City of North <br />Olmsted, a copy of said consent being a part of the permanent records of <br />the City of North Olmsted, adopting the necessary legislation abandoning <br />that portion of the aforesaid cul-de-sacs adjacent to their property and <br />thereby permitting said abandoned property to revert to the abutting property <br />owners in order that Ambour Drive will be a sixty (60) foot road westerly <br />from Claque Road to its westerly terminus, and <br />WHEREAS, the property description in ordinance t~To. 2796 <br />enacted January 1, 1959, was incorrect in that it ~J.d not express the <br />intention of council of the City of North Olmsted and council of the City <br />of North Olmsted hereby wishes to correct said property description, <br />NOW, THEREFORE, BE IT ORDAINED by Council of the City <br />of North Olmsted, State of Ohio: <br />Section 1: That Ambour Drive extending westerly from Claque <br />Road to its westerly terminus, being a 60 foot street and as the plat of Ohio <br />Shores Construction Corporation's Subdivisions No. 1 and 2 at the westerly <br />end of Ambour Drive as shown thereon exceeds 60 feet in width, that that <br />portion in excess of 60 feet at the points indicated as cul-de-sacs and <br />hereafter described as Parcel 1, Parcel 2 and Parcel 3 , Parcel 4 , Parcel 5 , <br />Parcel 6, Parcel 7 and Parcel 8, be and the same are hereby vacated: <br />
