()5 OF THE <br />NORTH OLMSTED CODIFIED ORDINANCES ENTITLED, <br />"MALICIOL?S DAMAGE OF BUILDINGS OR FIXTURES; <br />• 'TRESPASS, " AND DECLARING AN EMERGENCY. <br />WHEREAS, the 1965 State Legislature has enacted <br />certain changes in the state statutes, and <br />WHEREAS, Council is desirous of having legislation <br />enacted having to do with malicious damage of buildings or fixtures; <br />and trespass, and deems it advisable to enact a provision conforming to <br />the State Statute. <br />NOW, THEREFORE, BE IT ORDAINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section l: That. the Codified Ordinances of the City of <br />North Olmsted be amended by enacting Section 537.05 to read as follows: <br />537.05 MALICIOUS DAMAGE OF BUILDINGS OR <br />FIXTURES; TRESPASS. <br />Na person shall rnaliciously injure or deface a church <br />edifice, schoolhouse, library, tombstone or other cemetery property, <br />dwelling house or other building, its fixtures, books or appurtenances, or <br />commit a nuisance therein., Gr purposely and rrxaliciously commit a trespass <br />upon the enclosed grounds attached thereto or fixtures placed thereon, or an <br />enclosure or sidewalk about such grounds. {ORC 2.09. 09} <br />Section 2: That this ordinance is determined to be an <br />emergency measure necessary for the immediate preservation of the public. <br />peace, health, safety and welfare by virtue of the fact that the immediate <br />legislation is needed with respect to malicious damage of buildings or <br />fixtures; trespass. WHF_REFORE, this Ordinance shall take effect and. be <br />in force from ar~d after its passage, otherwise, at the earliest. period allowed <br />by law . <br />PASSED: ~ ~, ~ (~- <br /> <br />Francis J.
