"vUR~1~H O1_MSTEh <br />ORDINANCE NO. 65- ,345` <br /> <br />BY <br />e w <br />Al'v' ORDIl\?ANCE ENACTING SECTION 545.051 OF THE <br />NORTH OLMSTED CODIFIED ORDINANCES ENTITLED <br />"THROWING STO'V~ES AT PERSONS OR VEHICLES, "` <br />AND DECL.ARIi~'C~ AN E1~IERGENC:Y, <br />WHEREAS, the State i.egislature has enacted certain changes <br />in the State Statutes, and <br />WHEREAS, Council is desirous of hay+ing legislation <br />enacted having to do with throwing stones at persons or vehicles, and deems <br />it advisable to enact a provision conforming to the State Statute. <br />NOVV, THEREFORE, BE IT OKDAIN)~:D by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section l: "That. the Codified Ordinances of the City of <br />North Olmsted be amended by enacting Section 545. 051 to read. as follows: <br />545. 051 THROWING STONES AT PERSONS OR VEHICLES, <br />(a) No person. shall willfully and maliciously throw, <br />or by other means propel, a s'_.:r~e oz- other hard substance at or towards any <br />person. (ORC 2901, 251) <br />(bj No person shall willfully and maliciously throw a <br />stone or other substance or shoot a missile at or from: a railway car, train <br />or locomotive., or a z7~iotor bus or other motor vehicle. (ORC 2909. 12) <br />Section L: That t1Sis Ordinance is determined to be an <br />emergency measure necessary for the imrr~ediate preservation of the public <br />peace, health, safety and welfare by virtue of the fact that the immediate <br />legislation is needed with. respect to throwing stones at persons or vehicles. <br />WHEREFORE, this Ordinance shall take effect and be in force from and <br />after its passage, otherwise, a*. the earliest period allowed by law. <br />PASSED: 1 "~ / ~1~~, <br />Frances J.
