CITY OF NORTH OLN~STED <br />RESOLUTION N0. l <br />BY ~~~G'~ <br />A RESOLUI~ON AMENDING SECTIONS 1 AND ~+ <br />OF RESOLUTZON N0. 65-278 DECLARING IT <br />NECESSARY TO IMPROVE SOUTHERN AVENUE <br />BY PAVI1~ AND CONSTRUCTING CONCRETE <br />SIDEWALK5 TO REFLECT THE REVISION OF <br />PLAN'S TU INCLUDE STORM SEWER INLETS, <br />AND T~ECLARING AN EMERGENCY. <br />WHEREAS, the City Engineer has filed revised plans, specifications, <br />profiles and estimate of cost for the improvement oP Southern Avery as <br />described in Resolution No. 65-278, adopted November 16, 1~5, which <br />revised plans include the installation of storm sewer inlets as a ps~rt <br />of the improvement; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio: <br />Section 1. That Section 1 of Resolution No. 65-278, adopted Nov~tber <br />16, 1965, be and the same is hereby amended to read as follows: <br />"Section 1. That it is necessary to improve Southern <br />Avenue from McKenzie Road to a point 165 feet west of <br />Decker Avenue by constructing a 7-inch concrete pavement, <br />25.5 feet wide with appurtenances, including storm sever <br />inlets, and by constructing concrete sidewalks five feet <br />in width on both sides of said street between said points., <br />as shown on the plans hereinafter referred to and now on <br />file in the office of the Clerk of Council." <br /> <br />Section 2. That Section 4 of Resolution No. 65-278, adopted November <br />16, 1965, be and the same is hereby amended to read as follows: <br />"Section ~+. That the revised plans, specifications, <br />estimates and profiles of the proposed improvement, <br />heretofore prepared by the Engineer and now on file <br />in the office of the Clerk of Council, are hereby <br />approved." <br /> <br />Section 3. That as soon as the revised estimated assessments <br />reflecting the additional cost of the improvement have been prepared <br />by the City Engineer and filed with the Clerk of Council, said Clerk <br />shall cause notice of the adoption of this resolution and the filing <br />of said revised estimated .assessments to be served on the owners of <br />a11. lots and lands to be assessed as provided in R.C. Section 727.13. <br />Section ~+. That Sections 1 and ~+ of Resolution No. 65-278, adopted <br />November 16, 19b5, as they read prior to the amend~ents made hereby, be <br />and the same are hereby repealed in their entirety. <br />Section 5. This resolution is hereby declared to be an urgency <br />measure necessary for the immediate preservation of the public pewee, health <br />and safety of said City, and for the further reason that the immediate con- <br />struction of said improvement is necessary to eliminate existing hazards <br />to pedestrian and vehicular traffic of the abutting owners and the inhabitants <br />of the City; wherefore, this resolution shall be in full force and eYfect <br />from and immediately after its passage and approval by the Mayor. <br />Passed: ~ b <br />Attest: <br />C1er of ounci <br />President of Council <br />Approved; <br />Mayor <br />
