CITY OF NORTH OLMSTED <br />OR.DI.NANCE NO. 6fi- g.3 <br />AN ORDINANCE TO PROVIDE FOR THE PROPER <br />GRA17iNG OF LAND WITHIN SUBDIVISIONS,.) <br />WHEREAS, the City Engineer and the Building Department has <br />recommended that Council consider legislation providing for the proper grading <br />of land within Subdivisions; and <br />® WHEREAS, Council is of the opinion it would be to the best interests <br />of the citizens of North Olmsted that legislation be passed providing for the <br />proper grading of land within subdivisions and in addition thereto providing for <br />the transfer of responsibility for the grading of land from the developer to the <br />builder and finally the home owner. <br />NOW, THEREFORE, $E IT ORDAINED by the Council of the City of Ncrth <br />Olmsted, State of Ohio: <br />Section 1; That the developer be responsible for providing a topographic <br />map for the subdivision and in addition thereto be responsible far the establishment <br />of alI grades in the subdivision as determined by a competent surveyor until such <br />time as the subdivision is dedicated. <br />Section 2: That at the time said subdivision is dedicated no addition 1 <br />building permits will be issued to the individual builder in said subdivision until <br />each builder has deposited a sum of 5300.00 for each lot in said subdivision, <br />except that no individual builder will be required to deposit more than SI,500.00. <br />Should there be a delay of more than 30 days after dedication in the depositing <br />of grading account money, the building corinmissioner may revoke some or all of <br />the building permits previously issued to the individual builder. <br />Section 3:_' That this deposit shall be used for the establishing of <br />finished ground grades, the checking of alI grades to see if they conform to the <br />approved plans, and , if necessary, to grade the site in accordance with the <br />approved grading plan. Costs shall be calculated at a rate of 512.50 per hour for <br />the time spent by the City Engineer or his field group. <br />Section~„That if a grading account of an individual builder diminishes <br />below 5500.00 that particular builder will be required to deposit additional funds in <br />his grading account. When a particular builder has completed all of his houses <br />within the subdivision and his land has been graded to the satisfaction of the <br />City, he shall be refunded whatever balance might be remaining in his grading <br />aCCOUnt . <br />Section 5: That this ordinance is hereby declared to be an emergency <br />measure necessary for the preservation of the public peace, health, safety and <br />welfare of the City by virtue of the necessity of continuing to promote the orderly <br />development of land within the City of North Olmsted.
