CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2014 - 31 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 161.01 OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED <br />ENTITLED "EMPLOYEES GENERALLY" FOR THE PURPOSE OF <br />ACKNOWLEDGING AND ACCEPTING, UPON HIRE, EMPLOYEE <br />SICK TIME ACCRUED WITH ANOTHER GOVERNMENTAL <br />AGENCY AND FURTHER ESTABLISHING AN ADDITIONAL <br />RESTRICTION FOR PAYOUT OF SICK LEAVE UPON DEATH, <br />DISABILITY OR RETIREMENT. <br />WHEREAS, whenever the City hires a State or municipal employee that has <br />accumulated unused sick leave benefits from previous employment at another <br />governmental agency, the City is required by State law to acknowledge, transfer and <br />account for such sick leave credit; and <br />WHEREAS, the Administration recommends that Council establish systems for <br />transfer of sick time in compliance with State law yet limit payments for accumulated, <br />unused sick time upon death, disability or retirement to sick time credits earned during <br />service of the City; and <br />WHEREAS, it is accordingly the desire of this Council to amend Section 161.01 <br />in order to comply with State law and to manage disbursement of local benefits. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 161.01 ( "Non- Bargaining Unit Employee Benefits ") <br />of the Administrative Code, which presently reads as follows: <br />161.01 NON - BARGAINING UNIT EMPLOYEE BENEFITS. <br />(a) Sick Leave Policy. The sick leave policy for all non - bargaining unit <br />employees of the City, excluding elected officials, is hereby established as follows: <br />(1) Sick leave credit. <br />A. Accumulation of credit -sick leave is earned in accordance <br />with the state minimum requirement at the rate of one and <br />one - fourth days per month of employment or fifteen days <br />per year. <br />B. Regular full -time employees shall receive annual sick leave <br />according to the following formula: <br />Sick leave days per year = 1.25 x months x hours <br />8 <br />Sick leave days per year represent the eight -hour days <br />accumulated; months represents the months worked per <br />year; hours represents the hours worked per day. <br />
