CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2014 - 66 <br />BY: Mayor Kennedy <br />AN ORDINANCE DISPENSING WITH A FORMAL RFP PROCESS AND <br />AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT <br />WITH AMERICAN HEALTHWAYS SERVICES, LLC, TO PROVIDE <br />MARKETING SERVICES RELATED TO RECREATION CENTER <br />FITNESS PROGRAMS FOR THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, American Healthways Services LLC ( "Heathways ") provides unique <br />marketing services to fitness facilities, such as the new facilities opening at the North Olmsted <br />Recreation Center, including but not limited to networking systems and programs, under the <br />trade names Prime and SilverSneakers, to enhance membership and services; and <br />WHEREAS, the City Administration has determined and this Council is asked to <br />authorize acquisition of Healthways network and provider capabilities as necessary for the <br />marketing operation at the North Olmsted Recreation Center. <br />WHEREAS, Section 112.10(c) of the Administrative Code provides that as an <br />exception to the RFP process, the City, upon approval of the Council, need not conduct a <br />formal RFP if the services sought are of such a unique or specialized nature that conducting a <br />formal RFP will likely not result in obtaining proposals from two qualified firms; and <br />WHEREAS, it is accordingly the desire of this Council, in light of the proposed <br />networking and provider services, to authorize the Mayor to enter into an agreement with <br />Healthways for the purpose of providing marketing related fitness services for the City of <br />North Olmsted <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the formal RFP process required by Chapter 112 of the <br />Administrative Code is hereby dispensed with by reason of the unique marketing and network <br />provider services offered by American Healthways Services LLC by Agreement with the City <br />of North Olmsted, and that the Mayor be, and he hereby is authorized to enter into an <br />Agreement. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately so as to <br />
