CITY OF NORTH OLMSTED <br /> ORDINANCE NO. 2015—24 <br /> BY: Mayor Kennedy <br /> AN ORDINANCE AUTHORIZING THE DIRECTOR OF PLANNING <br /> AND DEVELOPMENT TO REQUEST PROPOSALS FROM <br /> QUALIFIED FIRMS TO PROVIDE PROFESSIONAL PLANNING <br /> AND ZONING SERVICES FOR THE ZONING CODE UPDATE <br /> PROJECT, AND FOLLOWING APPROVAL BY THE BOARD OF <br /> CONTROL, FURTHER AUTHORIZING THE MAYOR TO ENTER <br /> INTO A CONTRACT WITH THE FIRM DETERMINED TO <br /> PROVIDE THE BEST SERVICES AT A REASONABLE COST, AND <br /> DECLARING AN EMERGENCY. <br /> WHEREAS, the 2015 Master Plan was recently adopted and, among its several <br /> recommendations, is the ongoing review, audit and update of the City Zoning Code; and <br /> WHEREAS, the Director of Planning and Development recommends that the City begins <br /> the process to implement the recommendations of the 2015 Master Plan, commencing with area <br /> of greatest need and commercial importance, namely the Business Districts in Chapter 1139 of <br /> the Zoning Code; and <br /> WHEREAS, in accordance with said recommendations, it is the desire of this Council to <br /> so authorize the Director of Planning and Development to request proposals from professional <br /> corporations, firms or individuals qualified to provide such planning and zoning services for the <br /> update of the City's Zoning Code for future consideration by Council. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> NORTH OLMSTED, COUNTY OF CUYAHOGA,AND STATE OF OHIO: <br /> SECTION 1: That the Director of Planning and Development be and she hereby is <br /> authorized to request proposals from firms qualified to provide professional planning and zoning <br /> consultation services for the City of North Olmsted in accordance with the Request for Proposals <br /> prepared by said Director. <br /> SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board <br /> of Control, to enter into an agreement or agreements with the firm selected in the RFP process. <br /> Said agreement shall be in a form that is not substantially adverse to the City and which is <br /> approved by the Director of Law. The character of any content not being substantially adverse to <br /> the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the <br /> approval of the agreement by the Director of Law. <br />
