CITY OF NORTH OLMSTED <br /> ORDINANCE NO. 2015 - 42 <br /> BY: Mayor Kennedy <br /> AN ORDINANCE AMENDING SECTION 555.03(k) OF CHAPTER <br /> 555 (NOISE CONTROL) OF THE GENERAL OFFENSES CODE, <br /> ENTITLED "SPECIFIC PROHIBITIONS," IN ORDER TO <br /> REGULATE THE OPERATION OF LAWN MOWERS ON PUBLIC <br /> PROPERTY,AS AMENDED. <br /> WHEREAS, Section 555.03 of the General Offenses Code provides for <br /> prohibition of certain activities that create noises on or near residential properties; and <br /> WHEREAS, restrictions on the operation of lawn mowers prior to 8:00 a.m. <br /> and/or after 6:00 p.m. negatively impact the maintenance schedule and operation of <br /> public park, recreational and school facilities; and <br /> WHEREAS, it is the desire of this Council to amend Section 555.03(k) so as to <br /> permit the operation of lawn mowing equipment on public facilities from 7:00 a.m to <br /> 9:00 p.m.; <br /> NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF NORTH OLMSTED, CUYAHOGA COUNTY,AND STATE OF OHIO: <br /> SECTION 1: That Section 555.03 of Chapter 555 (Noise Control) of the General <br /> Offenses Code, which presently reads as follows: <br /> 555.03 SPECIFIC PROHIBITIONS. <br /> The following acts, and the causing or permitting thereof, are declared to be in violation <br /> of this chapter: <br /> (a) Animals and Birds. Owning, possessing or harboring any animal or bird which <br /> frequently or for continued duration, howls, barks, meows, squawks, or makes other <br /> sounds which create a noise disturbance across a residential real property boundary. <br /> (b) Places of Public Entertainment. Operating, playing or permitting the operation or <br /> playing of any radio, television, phonograph, drum, musical instrument, sound amplifier <br /> or similar device which produces, reproduces, or amplifies sound in any place of public <br />
