CITY OF NORTH OLMSTED <br /> ORDINANCE NO. 2015 - 45 <br /> BY: Mayor Kennedy <br /> AN ORDINANCE PROVIDING FOR THE SUBMISSION OF AN <br /> AMENDMENT TO THE ELECTORS OF THE CITY OFNORTH <br /> OLMSTED TO ARTICLE IV, SECTION 2 OF THE CHARTER <br /> OF THE CITY OF NORTH OLMSTED TO AMEND THE <br /> RESIDENCY REQUIREMENT FOR CITY COUNCIL WARD <br /> MEMBERS,AND DECLARING AN EMERGENCY. <br /> WHEREAS,the City Charter requires that in order to be eligible for service on City Council <br /> as a Council Member representing a Ward, an individual must have been a resident of the City for at <br /> least two (2) years and, additionally, a resident of the Ward for at least one (1) year prior to the <br /> appointment or election; and <br /> WHEREAS,most recently,in 2013,an individual expressed an interest in the Office of City <br /> Council from a Ward, when that individual recently had been redistricted to the Ward as a result of <br /> the mandatory redistricting process following the decennial Federal Census; and <br /> WHEREAS, through no fault of his own, the potential candidate, though maintaining the <br /> same physical residence, was no longer a resident of his longstanding Ward and had not been a <br /> resident of his new Ward for the requisite one (1)year,thus leaving him unable to seek office; and <br /> WHEREAS, it is the desire of this Council to submit to the voters of the City of North <br /> Olmsted a proposal to amend Article IV, Section 2 of the Charter of the City of North Olmsted so as <br /> to provide that any individual removed from his or her Ward as a result of redistricting shall be <br /> eligible to seek office in the new Ward provided that he or she has maintained the same physical <br /> residence and address, even if he or she has not been a resident of the Ward for one (1)year; and <br /> WHEREAS, this proposal was reviewed and recommended by the Charter Review <br /> Commission in accordance with Article XIV,Section(b)(1)of the City Charter,and the Commission <br /> on the 6th day of May, 2015, filed a written report with the Clerk of Council in which the <br /> Commission stated that, by a 7 to 0 vote, a motion to recommend approval of the proposal passed; <br /> and <br /> WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br /> than 120 days,and no later than 60 days,prior to the date of the election at which the issue will be <br /> voted upon by the electorate. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />
