CITY OF NORTH OLMSTED <br /> RESOLUTION NO. 2015 -43 <br /> BY: Mayor Kennedy <br /> A RESOLUTION AUTHORIZING THE MAYOR TO ENTER <br /> INTO A CONTRACT WITH LK HEATING & COOLING, INC. <br /> TO PERFORM MAINTENANCE SERVICES UPON THE <br /> HEATING AND COOLING EQUIPMENT AT VARIOUS CITY <br /> BUILDINGS,AND DECLARING AN EMERGENCY. <br /> WHEREAS, the Service Department has solicited quotes from several heating <br /> and air conditioning contractors to perform routine equipment maintenance at several <br /> City buildings; and <br /> WHEREAS, the Mayor has recommended that the City contract with LK Heating <br /> & Cooling, Inc. for the purpose of providing maintenance services to the heating and <br /> cooling equipment at various City buildings because the service has been good and their <br /> prices have remained low; and <br /> WHEREAS, it is the desire of this Council, acting upon the said <br /> recommendation, to authorize the Mayor to enter into a contract with LK Heating & <br /> Cooling Inc. to provide said services. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br /> OF NORTH OLMSTED, COUNTY OF CUYAHOGA,AND STATE OF OHIO: <br /> SECTION 1: That the Mayor be and he hereby is authorized to enter into an <br /> agreement with LK Heating & Cooling Inc. to provide maintenance upon the heating and <br /> cooling equipment in various City facilities, as set forth in the attached contract (marked <br /> as Exhibit A), with only such changes to said contract to be hereinafter made as are not <br /> substantially adverse to the City and which are approved by the Director of Law. The <br /> character of any such changes as not being substantially adverse to the City shall be <br /> evidenced conclusively by the execution of the agreements by the Mayor and the approval <br /> of the agreements by the Director of Law. <br /> SECTION 2: That this Resolution is hereby declared to be an emergency measure <br /> immediately necessary for the preservation of the public health, safety and welfare, and <br /> for further the reason that it is necessary that this Resolution go into effect immediately to <br /> provide continued maintenance and service, and further provided it receives the <br /> affirmative vote of two-thirds of all members of Council, it shall take effect and be in <br /> force immediately upon its passage and approval by the Mayor. <br />
