CITY OF NORTH OLMSTED ORDINANCE NO. 2015—76 By: Mayor Kennedy AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 1123 OF THE NORTH OLMSTED ZONING CODE ENTITLED "BOARD OF ZONING APPEALS"IN ORDER TO RECONCILE SAID CHAPTER WITH AN AMENDMENT TO CHARTER ARTICLE VII, SECTIONS 1 AND 4. WHEREAS, the electors of the City of North Olmsted will be presented in November of 2015 with a proposed amendment to the Charter of the City of North Olmsted merging the Board of Building Code Appeals and the Board of Zoning Appeals to form a new Building and Zoning Board of Appeals; and WHEREAS, if passed at the general election, the Board of Zoning Appeals and Board of Building Code Appeals will no longer exist and will be replaced with a new Building and Zoning Board of Appeals, thereby rendering the current Chapter 1123 moot; and WHEREAS, the Director of Planning and Development recommends that Chapter 1123 in the Zoning Code be amended for the reasons set forth herein; and WHF,REAS, after careful consideration, the Planning and Design Commission of the City, on the acriday of Soi},a, , 2015, by formal motion, recommended that this Ordinance amending Section 1123 of the Zoning Code, presently entitled "Board of Zoning Appeals," be (approved) (disapproved); and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, a public hearing was held on the (371* day of 064vb¢ii., , 2015; and WHEREAS, it is the desire of this Council to amend Chapter 1123 of the Zoning Code. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY,AND STATE OF OHIO: SECTION 1: That Chapter 1123 of the Zoning Code of the City of North Olmsted which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance and incorporated by reference as if fully rewritten herein.
