CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 —15 <br />By: Mayor Kennedy <br />AN ORDINANCE AMENDING VARIOUS SECTIONS OF <br />CHAPTER 911, "SEWERS GENERALLY" AND CHAPTER <br />917 "INDUSTRIAL PRETREATMENT" OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED <br />TITLED, "STREETS, UTILITIES AND PUBLIC SERVICES <br />CODE" IN ORDER TO CONFORM THE REQUIREMENTS <br />OF THE ENVIRONMENTAL PROTECTION AGENCY, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, in 2015 the Ohio Environmental Protection Agency ("EPA") undertook a <br />review of the Codified Ordinances of the City of North Olmsted for compliance with "EPA <br />Local Limits Development Guidance Appendices," 40 CFR Part 403, O.A.C. Chapter 3745-3 <br />and the Ohio EPA Pretreatment Streamlining Rule; and <br />WHEREAS, recommendations were made to modify provisions of Chapters 911 <br />(911.03; 911.12) and 917 (917.02; 917.03; 917.04; 017.05; and 917.06) of the Codified <br />Ordinances of the City of North Olmsted; and <br />WHEREAS, this Council wishes to conform the Codified Ordinances to the <br />requirements of the Ohio Environmental Protection Agency, as set forth herein. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, STATE OF OHIO THAT. <br />SECTION 1: That Chapters 911, Sections 911.03 and 911.12 of "Sewers Generally" <br />and Sections 917.02; 917.03; 917.04; 917.05 and 917.06 of "Industrial Pretreatment" which <br />presently read as set forth in Exhibit A, which is attached to this Ordinance and incorporated by <br />reference as if fully rewritten herein, shall be amended and, as amended, shall read as those <br />amendments are set forth in said Exhibit A. Any provision of Chapter 911 and Chapter 917 not <br />specifically amended herein shall remain in full force and effect. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that this legislation must go into effect immediately in order to be in compliance with <br />EPA recommendations; and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately following passage and <br />approval by the Mayor. <br />
