CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2017 - 34 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 915.06 OF THE STREETS, <br />UTILITIES AND PUBLIC SERVICES CODE OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED TO ELIMINATE <br />THE SWIMMING POOL CREDIT AND TO MONTHLY VERSUS QUARTE LY BILLING CYCLE, <br />HER REFLECT A <br />MONAND DECLARING <br />AN EMERGENCY, AS AMENDED. <br />WHEREAS, the City of North Olmsted owns and operates a sanitary sewer system (the <br />System) providing wastewater collection and treatment services to residential, commercial and <br />industrial users in the City and certain users outside of the City; and <br />WHEREAS, this Council is authorized and required to establish and maintain rates and <br />charges for the users of the System in order to fairly and equitably allocate the costs of, and to <br />provide funds to this City for the purpose of, operating, maintaining, repairing and replacing that <br />System, as well as paying costs of capital improvements (including debt service costs) associated <br />therewith, and may change those rates and charges as it deems advisable; and <br />WHEREAS, the Director of Public Service has requested that the "swimming pool credit" <br />be eliminated, since other methods are available to users to avoid the sewer charges; and <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 915.06 of the Streets, Utilities and Public Services Code, <br />titled "Billing of User Charges; General; Swimming Pool Credit," which presently reads as <br />follows: <br />915.06 BILLING OF USER CHARGES; GENERAL; SWIMMING POOL CREDIT. <br />(a) The user charges levied and the rates established by Section 915.04 shall take effect <br />immediately and shall be billed quarterly thereafter and be payable within ten days after billing. <br />Any premises making connection with the system after the beginning of any billing period shall <br />be charged a per diem prorated amount based upon the quarterly charge applicable, from the time <br />such connection is made until the commencement of the next following billing period applicable <br />to such premises. In case of failure to pay any bill for sewer charges when due, a penalty of ten <br />percent (10%) of such charge shall be added to such bill. <br />(b) The Director of Public Service is authorized to adjust any user charge levied in the event that <br />the user meets the following criteria: <br />
