CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2017 - 35 <br />BY: Mayor Kennedy and Councilwoman Hemann <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A <br />SHARED SERVICES AGREEMENT WITH THE CITY OF BAY <br />VILLAGE TO PROVIDE ANIMAL CONTROL SERVICES TO THE CITY <br />ON AN AS -NEEDED BASIS, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City is in need of animal control services; and <br />WHEREAS, the City of Bay Village is likewise in need of the services of an animal <br />control officer; and <br />WHEREAS, both City Administrations believe that the interests of its residents are <br />best served by working cooperatively with one another to provide excellent service in a cost <br />effective manner; and <br />WHEREAS, R.C. §9.482 authorizes political subdivisions to enter into agreements for <br />shared services; and <br />WHEREAS, it is the recommendation of the Director of Public Service that the City <br />enter into an Agreement with the City of Bay Village for the shared services of an Animal <br />Control Officer. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a contract <br />with The City of Bay Village in substantially the form and substance as evidenced in the <br />Agreement attached to this Ordinance as "Exhibit A," with only such changes to said contract <br />to be hereinafter made as are not substantially adverse to the City and which are approved by <br />the Director of Law. The character of any such changes as not being substantially adverse to <br />the City shall be evidenced conclusively by the execution of the agreements by the Mayor and <br />the approval of the agreements by the Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare; and <br />further provided it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />
