CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2018 - 41 <br />By: Mayor Kennedy <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL <br />EQUIPMENT EASEMENT LOCATED ON PROPERTY OWNED BY <br />ZAPATA REAL ESTATE, LLC., AN OHIO CORPORATION, <br />DESIGNATED AS PERMANENT PARCEL NUMBER 231-26-003 BY <br />CUYAHOGA COUNTY MAPS AND RECORDS, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the property owners, Zapata Real Estate, LLC., have worked with the <br />administration, including officials in Planning, Engineering and Law to address the details of <br />locating the traffic control equipment on its property, proximate to the right-of-way, in order to <br />accommodate the City's improvement of traffic signalization, and the City is grateful for the <br />conveyance of an easement; and <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation of the <br />Director of Law and the Director of Planning and Development and the City Engineer, to accept <br />the traffic control equipment easement and to provide for the recording of such conveyance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized and directed to accept, on behalf of <br />the City of North Olmsted, a Permanent Traffic Control Equipment Easement from Zapata Real <br />Estate, LLC, an Ohio Corporation, as the owners of Parcel 231-26-003, as further described <br />within said document, marked as Exhibit A attached hereto and incorporated herein by reference. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to <br />cause said easement to be recorded in the Office of the Cuyahoga County Fiscal Officer. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to obtain said easement in conjunction with the <br />public improvement project already existing and maintained on the property, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its passage. <br />PASSED: �i C <br />First Reading: 1/- 3- I1_� <br />Second Reading: q_ (7.1,I� <br />Third Reading: S-)- 1q, <br />Committee: � � l ;G <br />
