CITY OF NORTH OLMSTED ORDINANCE N0. 82- 175 BY: RONALD WILAM0SKY AN ORDINANCE VACATING PORTIONS OF ANTHONY ROAD AS WELL AS PORTIONS OF WEST 308TH STREET, WEST 309TH STREET, AND 310TH STREET IN THE ZEHMAN-WOLF AND SHERMAN CONSTRUCTION COMPANY'S NORTH OLMSTED SUB- DIVISION N0. 2, ALL OF WHICH IS MORE FULLY SET OUT IN THE VACATION PLAT PREPARED BY ALEX KANAREFF ? ASSOCIATES, CONSULTING ENGINEERS AND SURVEYORS DATED JULY, 1982. WHEREAS, a great portion of the Zehman-Wolf and Sherman Construction Company's North Omsted Subdivision No. 2, was divided because of the construction of Interstate 480, and WHEREAS, more recently the subject land which contained the streets which were previously dedicated for recording purposes only was purchased by Christ the King Comuunity for the purposes of constructing a education and religious community, and WHEREAS, this Council has determined that it is no longer necessary to retain those portions of the aforesaid streets for a public purpose, and that their vacation will not be detrimental to the general interest of the City, and WHEREAS, on the 3rd day of December, 1982, a petition by persons owning land in the immediate vicinity of Anthony Road and parts of West 308th Street, West 309th Street, and West 310th Streets, in the Zehman-Wolf and Sherman Construction Company's North Olmsted Subdivision No. 2, was duly presented to Council praying that the portions of the aforesaid streets, located in the Zehman-Wolf and Sherman Construction Company's North Olmsted Subdivision No. 2, be vacated, and the notice requirements specified in Ohio Revised Code Section 723.026 have been waived by virtue of consent of the affected parties, and WHEREAS, the Planning Commission on the day of , 1983, approved vacating that portion of the a oresai treets, which are more fully set out in the Vacation P at, which is attached hereto and marked Exhibit "A", finding that the aforesaid streets are no longer needed for street purposes, and 6VHEREAS, Council upon hearing, is satisfied that there is good cause for such vacation as prayed for, and that it would not be detrimental to the general interest, and ought to be made. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That that portion of the streets shown on Vacation Plat, w ich is marked Exhibit "A", of Anthony Road and parts of Ulest 308th Street, West 309th Street, and West 310th Street, in the Zehman-Wolf and Sherman Construction Company's North Olmsted Subdivision No. 2, be and the same are hereby vacated.
