CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82- 175 <br />BY: RONALD WILAM0SKY <br />AN ORDINANCE VACATING PORTIONS OF ANTHONY ROAD <br />AS WELL AS PORTIONS OF WEST 308TH STREET, WEST 309TH <br />STREET, AND 310TH STREET IN THE ZEHMAN-WOLF AND <br />SHERMAN CONSTRUCTION COMPANY'S NORTH OLMSTED SUB- <br />DIVISION N0. 2, ALL OF WHICH IS MORE FULLY SET OUT <br />IN THE VACATION PLAT PREPARED BY ALEX KANAREFF ? <br />ASSOCIATES, CONSULTING ENGINEERS AND SURVEYORS <br />DATED JULY, 1982. <br />WHEREAS, a great portion of the Zehman-Wolf and Sherman <br />Construction Company's North Omsted Subdivision No. 2, was <br />divided because of the construction of Interstate 480, and <br />WHEREAS, more recently the subject land which contained <br />the streets which were previously dedicated for recording purposes <br />only was purchased by Christ the King Comuunity for the purposes <br />of constructing a education and religious community, and <br />WHEREAS, this Council has determined that it is no longer <br />necessary to retain those portions of the aforesaid streets for <br />a public purpose, and that their vacation will not be detrimental <br />to the general interest of the City, and <br />WHEREAS, on the 3rd day of December, 1982, a petition by <br />persons owning land in the immediate vicinity of Anthony Road <br />and parts of West 308th Street, West 309th Street, and West 310th <br />Streets, in the Zehman-Wolf and Sherman Construction Company's <br />North Olmsted Subdivision No. 2, was duly presented to Council <br />praying that the portions of the aforesaid streets, located in <br />the Zehman-Wolf and Sherman Construction Company's North Olmsted <br />Subdivision No. 2, be vacated, and the notice requirements specified <br />in Ohio Revised Code Section 723.026 have been waived by virtue <br />of consent of the affected parties, and <br />WHEREAS, the Planning Commission on the day of <br />, 1983, approved vacating that portion of the <br />a oresai treets, which are more fully set out in the Vacation <br />P at, which is attached hereto and marked Exhibit "A", finding that <br />the aforesaid streets are no longer needed for street purposes, <br />and <br />6VHEREAS, Council upon hearing, is satisfied that there <br />is good cause for such vacation as prayed for, and that it would <br />not be detrimental to the general interest, and ought to be made. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That that portion of the streets shown on <br />Vacation Plat, w ich is marked Exhibit "A", of Anthony Road and <br />parts of Ulest 308th Street, West 309th Street, and West 310th <br />Street, in the Zehman-Wolf and Sherman Construction Company's <br />North Olmsted Subdivision No. 2, be and the same are hereby <br />vacated.
