Logan <br />A RESOLUTION ASSURING AN OPERATIOPJ AND MIAINTENANCE PROGftAM <br />IFJ COfJNECTION WITH THE TREATMEfdT WORKS IhTPROVEMENTS RELATING <br />TO THE CONSTRUCTION GRANTS PROGRAM. <br />4dHEREAS, regulations pertaining to Title 40 of the Code of Federal <br />Regulations require certain evidence of compliance with Section 35.925-10 <br />and 35.935-12 concerning an operation and maintenance program for Step 3 <br />Construction Grant. <br />NOW, THEREFORE, Be It Resolved by the Council of the City of Pdorth <br />Olmsted, County of Cuyahoga, and State of Ohio: <br />Section 1: That tlie Council of the City of North Olmsted hereby <br />provides assurance to the U.S. Environmental Protection Agency that the <br />treatment works will be operated economically, effectively, and efficiently <br />in accordance with a plan of operation approved by the Ohio Environmental <br />Protection Agency and in accordance with the minimum provisions for such a <br />plan as specified in Section 35.935-12(b). <br />Section 2: That the Council of the City of North Olmsted further <br />hereby provides that the following specifiC steps will be initiated and <br />implemented: <br />1. Provide an operation and maintenance manual for each facility, <br />including sewers, before the Regional Administrator pays more <br />than 50 percent of the federal share of any Step 3 project; <br />and no more than 90 percent of the federal share shall be <br />paid by the Regional Administrator until the City of North <br />Olmsted has provided a satisfactory final operation and <br />maintenance manual. <br />2. Provide an emergency operating and response program. <br />3. Provide properly trained management, operation, and maintenance <br />personnel. <br />4. Provide an adequate budget for proper operation and maintenance. <br />5. Provide monthly operational reports, according to the require- <br />ments of the State of Ohio. <br />6. Make provisions for laboratory testing adequate to determine <br />influent and effluent characteristics and removal efficiencies, <br />which will be required by the NPDES permit. <br />Section 3: This Resolution shall take effect and be in force from <br />and after the earliest period allowed by law.
