CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82- 115 <br />BY: <br />AN ORDINANCE CREATING A NEW CHAPTER IN THE TRAFFIC <br />CODE TO BE KNOWN AS CHAPTER 374 ENTITLED "MOPEDS", AS AMENDED. <br />WHEREAS, this Council has been made aware of the fact <br />that with the advent of the mopeds,the need for regulation of <br />the use of same has become greater, and <br />WHEREAS, it is the desire of this Council to adopt a new <br />ordinance dealing with the use and regulation of mopeds within <br />the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That there is hereby created a new Chapter <br />in the Traffi-'c Code, known as Chapter 374, entitled "Mopeds", <br />which new Chapter shall read as follows: <br />CHAPTER 374 <br />Mopeds <br />374.01 Definitions <br />As used in this Chapter: <br />(a) "Mopeds" means a motorized bicycle as any vehicle <br />with two tandem wheels or one front and two rear <br />wheels which is capable of being pedaled and is <br />also ec{uipped with a helper motor (ORD 4511.01(H). <br />(b) The helper motor must: <br />(1) Have a piston displacement of nor more <br />than fifty (50) cubic centimeters; <br />(2) Produce no more than one (1) brake <br />housepower; and <br />(3) Propel the vehicle at a maximum speed <br />no greater than twenty (20) miles per <br />hour on a level surface. <br />(c) Any motor driven or motor assisted cycle which exceeds <br />any of these limitations, is legally a motorcycle, and <br />is subject to all vehicle registration and operator <br />licensing requirements that apply to full sized motor- <br />cycles. <br />(d) In addition to the requirements listed above, all <br />motorized bicycles must also meet basic equipment <br />standards established by the Director of Highway <br />Safety. These requirements include: <br />(1) A working muffler and exhaust system, with <br />no cutouts or by-passes which allow excessive <br />noise. <br />(2) A firmly attached seat for the operator. Top <br />of seat must be at least twenty-five (25) inches <br />above the ground.
