14 <br />CITY 0F NORTH OLMSTED <br />RESOLUTION N0. 82-11 <br />BY: RONALD WILAMOSKY <br />A RESOLUTION OPPOSING THE PASSAGE OF HOUSE BILL <br />NUMBER 722, PRESENTLY PENDING BEFORE THE 114TH <br />GENERAL ASSEMBLY IN COLUMBUS, OHIO. <br />WHEREAS, House Bill Number 722 proposes to amend Section <br />2935.22 of the Ohio Revised Code to require that an offense <br />be charged and pxosecuted as a violation of a municipal ordinance <br />if the offense is a violation of both the municipal ordinance <br />and State Statute and is punishable as a misdemeanor, and <br />WHEREAS, it would anpear that the intent of the Ohio <br />Legislature, with respect to the introduction of this bill, <br />is to pass along the costs of housing pxisoners, when they, <br />in fact, are charged under State Code, if they could also be <br />charged under municipal ordinances, and <br />WHEREAS, the State of Ohio, through the Department of <br />Corection and Rehabilitation, has in the past established <br />stringent jail standards that are difficult for any municipal <br />corporation to meet, and <br />WHEREAS, those set standards make it very difficult to <br />house prisoners for the violation of any misdemeanors, and <br />WHEREAS, it is the desire of this Council to go on record <br />opposing House Bill Number 722 and to, at the same time, urge <br />the Legislature to have concern for iocal municipal corporations <br />rather than to continually protect the State of Ohio from costly <br />prisoner housing, while at the same time, failing to take any <br />corrective steps relative to the enforcement of overburdensome, <br />and often times, ridiculous jail standards. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUN1'Y Or CUYAHuGA AND S'I`ATE OF OHIO: <br />SECTION 1: That the Council and Administration urge the <br />General Assem ly to defeat House Bill Number 722, and to, at the <br />same time, commence a thorough examination of the question of <br />housing prisoners and the rec{uirements that have previously been <br />established by the adoption of minimum jail standards for Ohio. <br />SECTION 2: That the Clerk of Council be and she is hereby <br />directe to sen a copy of this Resolution to the Ohio House and <br />Ohio Senate, to State Representative Petro and Colona, to State <br />Senators Paul Matia, and Gary Suhadolnik, and to all muhiL- <br />cipal corporations in Cuyahoga County. <br />SECTION 3: That this Resolution shall take effect and <br />be in force rom and after the earliest period allowed by law.
