CITY OF NORTH OLMSTED ORDINANCE N0. 82 - 57 BY . AN ORDINANCF. ACCEPTING AN FASER![ENT FOR THF IN- STALLATION AND MAINTENANCE OF A!aATER LINF FOR THE pURPOSE OF SUPPLYINq WATF.R SERVICE BY THE CITY OF CLEVELAND TO LAND OtiVNEP BY THE GRFAT NORTHERN SHOPPING CENTER PARTNERSHIP, AND DF.CLARING AN EMERGENCY. WHEREAS, Great Northern Shonning Center Partnership desires to extend a water main into their nroperty, and WHFREAS, the City of Cleveland reauires that extension of water lines shall only be approved if easements are granted to both the City of Cleveland and the City of North Olmsted so that water mains may be constructed and maintai.ned therein, and WHEREAS, this Council deems it in the best interest o£ the City to acce-pt the easement described herein; attached Exhibit "A". NOW, THFRFFORE, BF IT ORDAIPJED BY THE COUNCIL OF THE CITY OF NORTFI OLMSTFII, COUNTY OF CUYAHOGA AND ST.ATE OF OHIO: SECTION 1: That this Council does hereby accept an easement from Great_Northern Shopping Center Partnership for the installation and maintenance of a watex main for the purnose of supplying water service by the City of Cleveland to property of Great Northern Shonping Center Partnership. SECTION 2: That the Clerk of this Council is hereby authorized to fortivard a certified cony of this Ordinance to the Director of Public Utilities of the City of Cleveland. SFCTION 3: That it is found and determined that all formal actions of t?is Council concerning and relating to the adontion of this Ordinance were adonted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. SECTION 4: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and wel£are, and for the further reason that it i_s necessaxy to accent said easement in order that the developer may have water availahle at the time of completion of the building for occupancy, and further nrovided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and he in £orce immediately unon its nassage and approval by the Mayor.
